<br />CASE # ~ <br /> <br />Public Hearing <br />REQUEST FOR A HOME OCCUPATION PERMIT; <br />. CASE OF GENE AND CINDY GOEDE <br />By:'Tim Gladhill, Associate Planner <br /> <br />Background: <br /> <br />The City has received an application from Gene and Cindy Goede .for a home occupation permit <br />to establish a tree service located at 17725 Baugh Street NW. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site layout <br />c) Building plans <br />d) Proposed fmdings of fact <br />e) Proposed home occupation permit <br /> <br />Notification: <br /> <br />In accordance with State statute, Staff notified property owners within 350 feet of the subject <br />property of the public hearing. <br /> <br />Observations: <br /> <br />On October 16, 2008, the applicant applied for a building permit to construct a 4,000 square foot <br />accessory structure on the subject property. During review of that permit, it was discovered that <br />a business was being operated on the subject property and that a portion of the proposed <br />accessory structure was to be used for the home occupation. This home occupation has been in <br />operation for some time, arid the City has not received any complaints to date. <br />. . <br /> <br />City Council recently approved an amendment to the home occupation permitto allow for many <br />home oGcupations to be approved administratively. However, it is staff's opinion that the level <br />of activity on the site operates beyond the parameters state,d in City Code and therefore <br />necessitates the application to be processed in accordance with procedures established for <br />c.onditional use permits, pursuant to:City Code Section 9.11.04 (Home Occupations). There is <br />significant outside. storage of tree trimmings, as well as a potential for excessive noise and <br />vibration from wood chippers. <br /> <br />City Code Section 9; 1 f04 states that a home occupation is permitted if the property is at least <br />three acres in size, said business is low intensity, and does not adversely affect the character of <br />the residential neighborhood. A home occupation permit is required to operate a home based <br /> <br />27 <br />
