<br />significant concern that a sprinkler system will not be installed and that people could get trapped <br />in the building in the event of a fire. . <br /> <br />Fire Chief Kapler stated he has taken into account what types of materials will be located in the <br />building and determined that the level of combustibles will be minimal; in addition, given the <br />limited number of uses per week in the building, he felt it was an acceptable risk as long as it is <br />understood that the use will be temporary. <br /> <br />Commissioner Cleveland asked if fire extinguishers will be located on the premises. <br /> <br />Fire Chief Kapler replied in the affirmative. <br /> <br />Commissioner Cleveland asked if the City has allowed other similar uses of this type in the City <br />and whether it has waived the requirement for a sprinkler system. <br /> <br />Fire Chief Kapler stated he believed this is the first change of use the City has allowed. <br /> <br />Commissioner VanScoy asked Fire Chief Kapler if he would support the Interim Use Permit if <br />the applicant re-applied for this use at the end of the three-year term. <br /> <br />Fire Chief Kapler replied he would likely not support it. <br /> <br />Chairperson Nixt asked how staff would enforce the compliance process with respect to the level <br />of combustibles stored on the premises. <br /> <br />Fire Chief Kapler replied the building would be inspected at least annually to perform routine <br />inspections and added that staff has been reassured by the applicant that there will be a minimum <br />level of combustibles stored in the building. <br /> <br />Chairperson Nixt stated the permit does not include any language that would give the City the <br />ability to pull the permit if staff became uncomfortable with the level of combustibles on site. <br /> <br />Fire Chief Kapler stated if any business in the City is found to be operating in an unsafe manner, <br />he has the authority to stop it. <br /> <br />Chairperson Nixt stated that given the unique nature of the applicant's proposed use, it appears <br />the Fire Chief is willing to allow the use on a temporary basis due to their unique circumstances <br />with the expectation that they will have a lower level of potentially combustible materials stored <br />on site. He asked if language should be added to the Interim Use Permit stating that the City has <br />determined that the applicant's use is compatible with this exception because the applicant will <br />not incur an unreasonable amount of storage that could raise concerns with respect to fire safety. <br />He added there is a good faith expectation here regarding the applicant's storage of materials on <br />site. <br /> <br />Planning Commission/October 2, 2008 <br />Page 5 of 15 <br />
