<br />Community Development Director Miller pointed out that the permit contains a provision (No. <br />11) which clearly indicates that the City may amend, suspend, or revoke the Permit consistent <br />with applicable law if it is determined that continued operation of the facility places the public <br />health, safety or welfare, or the environment in jeopardy. <br /> <br />Chairperson Nixt stated it is important to have a defensible position and felt it was appropriate to <br />include a specific finding of fact to grant the interim use and to craft specific language in the <br />permit itself that embellishes upon that standard. <br /> <br />Fire Chief Kapler suggested language that states no flammable storage is permitted other than <br />light maintenance types of things (cleaners, etc.) and ordinary combustibles could not be stored <br />in any manner and that only a reasonable amount of combustibles could be stored for an <br />administrative type of use. <br /> <br />Commissioner Brauer stated it appears there is a concern regarding proper storage of <br />combustibles and suggested amending provision number 7 of the permit to include language <br />regarding the proper storage of combustibles. <br /> <br />Fire Chief Kapler suggested including the requirement for a lockbox on the front of the building <br />to allow access to the building by City staff for the purpose of inspecting the property without the <br />necessity of having someone from the church present. <br /> <br />Chairperson Nixt stated he would prefer to avoid having an inspection schedule included in the <br />permit due to the onerous nature of adhering to the inspection schedule by City staff. He <br />indicated he would prefer something more broad that states the City may, in its discretion, <br />inspect the property as it relates to combustible material storage and retains the ability to cite the <br />applicant for any violations and/or pull the permit in the event of cited violations. <br /> <br />Commissioner Brauer suggested amending provision #7 of the permit to state "That the City <br />Administrator or his or her designee shall have the right to inspect the Subject Property for <br />compliance, safety purposes, and proper storage and quantities of combustibles at any time." <br /> <br />Chairperson Nixt directed staff and counsel to revise the language as appropriate. <br /> <br />Mr. Joel Buttenhoff asked if they will be provided a time frame within which to remedy any <br />perceived violation with respect to combustibles. <br /> <br />Fire Chief Kapler replied that depending on the situation, the City will work with any business to <br />remedy violations and allow that business a reasonable amount of time to. resolve any issues <br />raised by the City. <br /> <br />Commissioner Van Scoy questioned whether Finding of Fact #7 should be revised. <br /> <br />Commissioner Brauer stated the law requires the installation of a fire suppression system and this <br />statement states a fact. <br /> <br />Phinning Commission/October 2, 2008 <br />Page 6 of 15 <br />
