<br />Councilmember Dehen asked what the City did as far as investigating the situation and what <br />kind of complaints had been received. ' <br /> <br />Police Chief Way stated that the APS people have helped out at the site and one of-the officers <br />had also been on site numerous times to assist. He stated that he wanted to ,make -it clear that the <br />issues are not just computer errors, but not getting identification and guns not being entered into <br />the system, which. have nothing to do with the computer system. <br /> <br />. Council1l,1ember Dehen asked about the quantity of the violations. <br /> <br />City Attorney Goodrich noted that this information was inch~ded in the findings of fact and <br />reviewed some of that information. , He stated that on October 29, 2007, the Police Department <br />met'with Mr. Jerdiri. to, discuss the 'continuing non-compliance issues. He stated that not every <br />violation, was entered'into the hearing, but there were 70 violations as part of the record. <br /> <br />Councilmember Dehen asked what obligation the City has to assist an owner with' compliance. <br />He asked if the City assisted the former owner. ' <br /> <br />Police Chief Way stated that the City did not assist the former owner to this degree. He stated <br />that the Police Department is notified by APS when there are issues. <br /> <br />Mr. Bogart stated that they were trying to correct the records and noted that much of the' contact <br />with the Police Department was initiated by Mr. Jerdin asking for help. He stated 'that he wanted <br />to correct Police Chief Way that APS has not been on site, but they have been working with Ms. <br />Pederson by phone and e-maIl. <br /> <br />Counci1r?ember Look stated that the transcript from the hearing states that Mr. Jerdin was having <br />problems with the computer system. He stated that City staff is not familiar with the Xpawn <br />software and he questions whether staff going to help out was the best thing to do. <br /> <br />Police Chief.Way stated that APS was on site to set up the system, the City did not set that up. <br />Mr. Bogart stated that they were on site under the old ownership back in 2004 or 2005. <br /> <br />Councilmember Look stated that he had read through the transcript. He stated that he is also a <br />small business owner 'and is required to E-file sales and use taxes and noted that this system is <br />complicated. He state(l that he wouldn't be surprised if Xpawn is also a difficult to understand <br />system. He stated that he understands that some mistakes have been made, but he would like to <br />, be cautious before bringing the "gavel" down on Mr. Jerdin. He s~ted that recently the City had <br />a problem where a building permit was issued, but was never followed up on to see if the <br />permitted 'structure had been built, so the City doesn't always cross its T's and dot its I's either. <br />He stated that he would also like to state that this could result in li/ suspension, not just a <br />revocation. <br /> <br />City Council/May 27, 2008 <br />Page 7 of 1~ <br />
