' <br /> <br />Councilmember Olson stated that having heard Mr. Jerdin and Mr. Bogart explain the computer <br />system problems, she is not so concerned with those'violations. She stated that she has known <br />Mr. Bogart for along time and knows that he is very good at what he does. She stated that if he <br />, says he has the computer problems straightened-out, then she believes'him. She stated that her <br />, concerns now are in the non~computer related violations such ~ not getting proper m., ' <br /> <br />Mr. Jerdin stated that 'onlyhappened one time and he admits it was ,a big, mi~tak:e. <br /> <br />Mr. Bogart ~tated that Mr. Jerdin has paid for new upgraded software and, has been writing <br />everything down. -' <br /> <br />Councilmember Look stated that it is stated in the transcript that nobody on the Police <br />Department had technical knowledge of this software and perhaps they should have stood back <br />and not tried to help in that capacity since they didn't have the neces~ary expertise: <br /> <br />Councilmember Jeffrey reiterated that it is incumbent on the business owner to get the necessary <br />expertise and not the City. <br /> <br />Councilmember Dehen stated that he understands that mistakes happen, but at some point, there <br />needs to be a shift froni mercy mode to consequences mode. He stated that the City had an <br />independent hearing officer weigh in. He stated that the hearing examiner recommended, <br />revocation, not suspension. , He stated that he doesn't feel he is in the position to go back and <br />decide for ,himself whether the excuses are credible or not. He stated that he has worked with . <br />Michael Scott before and respects, his recommendation.-He stated that there comes a point where.. <br />enough is enough and a business cannot be run like this. <br /> <br />Mayor Gam~c asked if there had been any changes or additional violations since the March 3, <br />2008 hearing. <br /> <br />Police Chief Way stated that there had been further violations. <br /> <br />City Attorney Goodrich clarified that there have been alleged violations since the March 3, 2008 <br />hearing. ' <br /> <br />Councilmember Look asked how many of the violations can be tracked to the time frame when <br />Mr, Jerdin took over the business, versus the old errors "coming out of the woodwork". <br /> <br />, Mr. Jerdin stated that the current alleged violations are from old violations that caused errors to <br />. show up in the report. <br /> <br />Chy Council / May 27, 2008 <br />Page 8 of 15 <br />
