He asked how the rest of the Counci) would feel about a <br />review period of something like 120 days to see how the reports came back and if this continues <br />to be a problem, he would have no problem revoking this license. <br /> <br />. . <br />C01;U1ci1me~ber Dehen stated that he isn't sure if the City could do that, because if there are new <br />violations, 'Mr. Jerdin.would be entitled \0 another hearing. . <br /> <br />City Attorney Goodrich stated that he believes the City cQuld suspend the pawnbroker license for <br />30 days during which time Mr. Jerdin could act as a second hand goods dealer, but not pawn. He <br />, stated, that, there could also be a review penod where a certain. threshold would need to be <br />accomplished, but he would need time to dl-aft this. He reiterated that staff believes that at least a <br />suspension is in order because of the violations th~t they have proven over the past year. <br /> <br />Mr~ Jerdin stated that he has a document from apother pawnshop that shows that they have had <br />50 violations. <br /> <br />Mayor Gmnec 'stated. that the discussiqn'tonight is about Ralph's Gun and Pawn and not other <br />shops. ' <br /> <br />. Councilmember Look stated that he agreed that there should be repercussions for the violations <br />and would support a suspension for a period of time in, which Mr. Jerdin could not pawn,'but <br />could sell inventory. He stated that he would also be.in favor of a list of guidelines that must be <br />met by Mr. ~erdin. <br /> <br />Councilmember Stro~en stated that she is confused by the correct process, because if the <br />Council doesn't think the threshold for revocation has been met already, how will it be met in <br />120 days. She stated that there was an: independent reviewer who expressed.his opinion that the <br />license should be revoked and while the Council has heard Mr. Jerdin's side oftl).e story tonight, <br />she thinks it Will be the S!ll11e situation in 120 days. . <br /> <br />Councilmember Dehen stated that he has concerns because the 'City has spent money on a <br />hearing officer and other staff resources. He asked if there was a way to have a monetary fine <br />for these violations. . <br /> <br />City Attorney Goodrich stated that the City cannot issue a monetary fine in this instance. <br /> <br />Councilmember Olson stated that, in her opinion, suspension of his license is the equivalent to a <br />monetary fme. She asked if, when creating the gijidelfu.es for:Mr. Jerdin, there was an industry <br />average for errors. . ' <br /> <br />Councilmember Strommen stated that she is concerned that with these guidelines, the City is <br />setting up an acceptable threshold for violations.
