CASE # 3 <br />REQUEST FOR A HOME OCCUPATION PERMIT AND INTERIM USE PERMIT TO <br />EXCEED ACCESSORY STRUCTURE SPACE; <br />CASE OF GENE AND CINDY GOEDE <br />By: Tim Gladhill, Associate Planner <br />Background: <br />The City has received an application from Gene and Cindy Goede (Ga -dee) for a home <br />occupation permit to establish a tree service located at 17725 Baugh Street NW. <br />The following items are enclosed for your information: <br />a) Site location map <br />b) Site layout <br />c) Building plans <br />d) Site Photos <br />e) DRAFT Planning Commission Minutes dated November 6, 2008 <br />e) Proposed findings of fact related to a Home Occupation Permit <br />f) Proposed Home Occupation Permit <br />g) Proposed findings of fact related to an Interim Use Permit <br />h) Proposed Interim Use Permit <br />Notification: <br />In accordance with State statute, Staff attempted to notify property owners within 350 feet of the <br />subject property of the public hearing. <br />Observations: <br />Home Occupation <br />On October 16, 2008, the Applicant applied for a building permit to construct a 4,000 square foot <br />accessory structure on the subject property. During review of that permit, it was discovered that <br />a business was being operated on the subject property and that a portion of the proposed <br />accessory structure was to be used for the home occupation. This home occupation has been in <br />operation for 10 years, according to the Applicant. The City has not received any documented <br />complaints to date. <br />As Council may recall, an amendment to the home occupation ordinance to allow certain types of <br />home occupations to be approved administratively was recently approved. However, it is staff's <br />opinion that the level of activity on this site is beyond the parameters stated in City Code. This <br />application should be processed in accordance with procedures established for conditional use <br />
