If another similar report is submitted <br />for the dog declared `potentially dangerous', the property owner will be required to register the <br />dog as a `dangerous dog' with the Ramsey Police Department and is subject to additional <br />requirements as stated by State Statute and local ordinance. <br />To provide assurance that the Applicant's dogs will not have an opportunity to run at- large, staff <br />recommends that a permanent fence be constructed to contain the dogs on the subject property if <br />the permit is to be approved. Two of the four dogs are relatively small in size and the subject <br />property is 2.72 acres. It appears that with proper containment the Applicant would be able to <br />safely keep four dogs on the property. <br />On November 6, 2008, the Planning Commission met to discuss the request to keep four dogs, <br />and consider concerns from the public. <br />Recommendation: <br />The Planning Commission met on November 6, 2008 to hold a Public Hearing and recommended <br />approval of the Conditional Use Permit with changes to condition #6, to require permanent <br />confinement area to be contiguous to the residence. The Planning . Commission also <br />recommended approval of the associated findings of fact with changes to #9 and #11. <br />The Planning Commission recommended that effective containment of the Applicant's dogs <br />must consist of a permanent physical fenced -in confinement area contiguous to the residence. To <br />be consistent with the intent of the required permanent confinement area, enclosed by a <br />permanent physical fence, the option to use a leash on the subject property was removed from <br />condition #5 by staff. <br />After the meeting of November 6, 2008, feedback was received from the applicant who <br />explained that construction of the required fence would not be possible immediately because <br />many fence contractors will not have . schedule openings until spring -time when the ground <br />thaws. In order to ensure the confinement objective of the Planning Commission is met, staff <br />added conditions #7 and #8 to the permit, placing a deadline for the installation of the fence. The <br />deadline of April 30 2009 meets the needs of the applicant and promotes the construction of the <br />required permanent confinement area on the subject property. <br />—202— <br />Funding Source: <br />All costs associated with processing the application are the responsibility of the applicant. <br />Council Action: <br />Motion to adopt Resolution #08 -11 - adopting Findings of Fact # relating to the <br />applicant's request for a conditional use permit for a private dog kennel for four dogs at 6250 <br />160 Lane NW. <br />
