Anoka County Contract No. AGREEMENT FOR CONSTRUCTION OF STORM SEWER OUTLET AND TRAIL THROUGH MISSISSIPPI WEST REGIONAL PARK This agreement is made and entered into this _ day of December, 2008, by and between the County of Anoka, a political subdivision of the State of Minnesota ("County") and the City of Ramsey, a municipal corporation under the laws of State of Minnesota ("City"). WITNESSETH: WHEREAS, the City is .required by the Lower Rum River Watershed Organization to construct a storm sewer outlet from its storm water holding pond located south of Highway 10 to the .Mississippi River; and WHEREAS, the City has requested the County to grant a permanent utility .easement through the Mississippi West Regional Park over, under and across Outlots B & E, Tooth Acres, Anoka, Minnesota for the installation and maintenance of a storm sewer. outlet pipe to accommodate the said storm water outlet (the "Pipe Line Easement"); and WHEREAS, the City has requested the County to grant a permanent trail easement through the Mississippi West Regional Park over, under and across said Outlots B and E for the installation of a 10 ft wide bituminous trail to provide access to the Mississippi River for the public (the "Trail Easement");.and WHEREAS, subject to the terms and conditions contained herein the County agrees to grant the .easements to the City to facilitate the construction and continued maintenance of the Pipe Line and Trail. NOW, THEREFORE, in consideration of the premises and good and other valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties hereto agree as follows: I. GRANT OF EASEMENT Subject to the terms and conditions contained herein, the County agrees to grant to the City a permanent Pipe Line Easement- and the -Trail Easement through the Mississippi West Regional Park under, over and across Outlots B and E Tooth Acres. The grant of the easements shall be made by the execution and delivery of an easement document in substantially the form in Exhibit A, which is attached hereto ("Easement"). II. CONSIDERATION FOR GRANT OF EASEMENT As consideration for the grant of the Easement, the City shall reimburse the County one dollar and other good and valuable consideration. The Pipe Line Easement and Trail. Easement shall be constructed in conformance. with. plans and specifications prepared by the City, a copy of which is attached hereto as Exhibit B. -217-
