<br />Councilmember Dehen stated that many times judges or a hearing officer will say, "before I <br />make a decision, I want to work through the Findings of Fact". He stated that this is forcing <br />them to make a decision and then come back with their Findings of Fact. He stated that <br />procedurally, it seems a little off. <br /> <br />Mayor Gamec stated that he thinks the way it is stated it will speed things up. <br /> <br />Councilmember Dehen stated that he is fine with it, but it is just a little odd, procedurally. <br /> <br />Police Chief Way stated that if there is an issue, the City would have the Findings of Fact to <br />support the decision. <br /> <br />Councilmember Strommen stated that she is willing to see how it works, as it is written. <br /> <br />Councilmember Dehen stated that the highlighted areas on page 15 are fine, but he feels there <br />should be a definitive paper trail to indicate to the owner what will happen. He stated that this <br />way, people can't come back and say, "well, geez, I didn't know you were going to destroy the <br />property" . <br /> <br />Police Chief Way stated that the notice should include the language from number 5 on page 15. <br /> <br />Councilmember Strommen stated that under 4b, there is another mention of a notice and she <br />feels that should contain the same information. <br /> <br />Councilmember Dehen stated that it could also be included in the original letter or, if there is an <br />appeal, in that letter also. <br /> <br />Police Chief Way stated that he will include it in the notice and outline what the City will do. <br /> <br />Mayor Gamec stated that when the City does this, it picks up what is called "junk" and asked if <br />that is held for a certain amount of time. <br /> <br />Police Chief Way stated that currently, the City holds it, but the time varies because it isn't <br />specified, which is why a specific time frame was included in these revisions. <br /> <br />Councilmember Olson asked if there was anything stored right now. <br /> <br />Police Chief Way stated that he thinks there may be a boat in storage. <br /> <br />Councilmember Elvig suggested that Mayor Gamec not refer to the stuff as "junk" at the Council <br />meeting. <br /> <br />Councilmember Jeffrey asked when this would come before the Council for a vote. <br /> <br />City Council Work Session / November 10, 2008 <br />Page 3 of9 <br />
