Mr. Jankowskl stated the City would require the developer to grade
the entire road from St. Francis ~iV~. to the end. At a future
point in time when paving is petitioned for, it would be installed
under the special assessment procedure.

Mr. Gerald Bauer agreed to the proposal. At the time it Is
blacktopped, he would discuss with the City Engineer whether to put
in curb or a ditch section. He also stated the road is out of
alignment, presently encroaching on Tom and Bonnie King. He
thought possibly the whole road could be shifted to the south in
the easement to stay away from that house.

Mr. Tom King, 5915 177th Avenue NW, stated as long as the road does
not bother his fence, he would have no objections.

Mayor Gllbertson suggested meeting on site with Mr. Jankowskl, Mr.
Bauer and affected neighbors once the documentation is completed so
everyone would know the effect of the future street.

Mr. Jankowskl personally preferred the street to be in the middle
of the right-of-way; however, If it provides a hardship for some of
the residents, he had no problem moving it somewhat.

Councllmember Beyer asked about the Park Board recommendation to
waive the park dedicate fee until the building permit is issued.

Mr. Frollk explained the City Code requires collection of park
dedication at the time the plat Is recorded. Attorney Goodrich
concurred that based on the ordinance, the fees must be paid at the
time of recording.

Ms. Frollk also explained that on Lots 2 and 3, park dedication
fees are charged against only one unit. ]f the property is
resubdlvlded in the future, they will get credit for one unit and
will have to pay park dedication for the remaining acreage.

MOTION by Councllmember Peterson, Seconded by Councllmember Clch,
to adopt Resolution #91-04-076 granting final plat approval to Echo
Ridge contingent upon approval of the grading plans.

Motion carried. Voting Yes: Mayor Gilbertson, Councitmembers
Hardin, Peterson, Beyer and Clch. Voting No: None.

CASE # 4: Request for AdJustment to Escrow Account Charges

Mrs. Helllng reviewed the background of Mr. Glen Rychner's request
to adjust the charges made against the escrow account for the first
Conditional Use Permit application for Aluminum Recycling, Inc. to
operate an aluminum processing center at 14280 Sunfish Lake
Boulevard. The Staff Is recommending that his account be credited
in the amount of $891 based upon the time spent researching the
City's new ordinances.

CITY COUNCIL/APRIL 9, 1991
