Councilmember Elvig introduced the following resolution and moved for its adoption: RESOLUTION #08-11-226 A RESOLUTION ADOPTING FINDINGS OF FACT #0836 RELATING TO A REQUEST FROM GENE AND CINDY GOEDE FOR A HOME OCCUPATION PERMIT TO OPERATE A TREE SERVICE BUSINESS ON THE PROPERTY LOCATED AT 17725 BAUGH ST NW. WHEREAS, the City of Ramsey received an application from Gene and Cindy Goede requesting a home occupation permit to operate a tree service business in a principle dwelling unit and accessory structure located on the property generally known as 17725 Baugh St NW and legally described as follows: The south 495 feet of the west 880 feet of the Southwest Quarter ofthe Northeast Quarter of Section 6, Township 32, Range 25, Anoka County, Minnesota as measured at right angles to the south and west lines thereof (subject to County Road No. 83 Baugh Street) (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: 1. That on October 28,2008, Gene and Cindy Goede, hereinafter referred to as "Applicant", properly applied for a principle dwelling and accessory structure home occupation permit (the "Permit") to operate a tree service on the Subject Property. 2. That businesses operating within a principle dwelling or accessory structure in the R-l Residential District require the issuance of a home occupation permit. 3. That on June 16,2008, the City Council adopted a home occupation ordinance allowing residents the ability to apply for a home occupation permit to operate a business within an accessory structure and employ non-resident employees as outlined in the home occupation ordinance. 4. That the Applicant has stated that the business has been operating for several years on the Subject Property. 5. That the City has not received any ordinance complaints regarding the operation of the home occupation on the Subject Property. 6. That the Applicant appeared before the Ramsey Planning Commission for a public hearing pursuant to Section 9.03.05 of the City Code on November 6,2008, and that said public hearing was properly advertised. 7. That the Subject Property is zoned R-l Residential - Rural Developing, and the surrounding parcels are also zoned R-l Residential- Rural Developing. 8. That the Subject Property is approximately 9.3 acres.
