<br />9. That the Subject Property is surrounded by lots of various sizes; residential lots on the <br />east side of Baugh Street range from approximately 1.5 acres to 2.5 acres, and to the <br />south is a 4.5 acre residential parcel. <br /> <br />10. That the Applicant will reside in the home on the Subject Property. <br /> <br />11. That the Subject Property is at least three (3) acres in size and therefore the Applicant is <br />eligible to apply for a home occupation permit to operate a business within an attached <br />accessory structure and employ at most three (3) non-resident employees, unless <br />otherwise permitted by City Code. <br /> <br />12. That the accessory structures for use of the home occupation are located on the Subject <br />Property. <br /> <br />13. That the Applicant's business currently has five commercial vehicles to support the <br />operation of the tree service. <br /> <br />14. That the Applicant's business does not typically receive material truck deliveries, <br />generally does not have customers coming to the property, and is located on a county <br />road; therefore, the use should not create excessive vehicular traffic to the Subject <br />Property as defined in City Code Section 9.11.04. <br /> <br />15. That the Applicant's business hours are Monday - Friday 10:00am - 5:00pm. <br /> <br />16. That there is currently outside storage of business materials or product on the Subject <br />. Property. <br /> <br />17. That the home occupation has the potential to create a nuisance to neighbors because of <br />excessive noise and vibration from equipment on the Subject Property. <br /> <br />18. That there is a parking demand in excess of that which can be accommodated on the <br />driveways of the Subject Property. <br /> <br />19. That there would be no exterior signage promoting the business on the Subject Property. <br /> <br />20. That all structures shall comply with all applicable codes, including building, fire and <br />zomng. <br /> <br />21. That the Subject Property has parking and maneuvering areas which are not prepared <br />with acceptable materials as defined in City Code Section 9.11.08. <br /> <br />22. That the proposed use will not adversely impact traffic in the area. <br /> <br />23. That the proposed use will be compatible with the residential. neighborhood due to <br />density and lot size of the surrounding lots. <br /> <br />24. That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use or to the public welfare. <br /> <br />RESOLUTION #08-11-226 <br />Page 2 of3 <br />
