Case W/: Introduction of Ordinance Amending 7.61 Charitable Gambling and <br /> 7.62 Bingo Within the Code of Ordinances <br /> <br />Mr. Schroeder stated that under State Statute, a City may, by ordinance, require that lawful <br />gambling within the city must spend all or a portion of its revenue within the city's trade area and a <br />city also has the authority to require an organization to make a specific expenditure of up to 10% of <br />their net profits derived from lawful gambling to a fund administered and regulated by the local unit <br />of government. The City of Ramsey's ordinance doesn't state either provision. Mr. Schroeder <br />checked with the neighboring cities regarding their ordinances and found that a couple of them <br />provided that 10% of the gambling proceeds would go directly towards uses defined by that city or <br />some percentage of the net profits had to be spent within the trade area of the city. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beyer to introduce <br />Ordinance #91-XX entitled Introduction of Ordinance Amending 7.61 Charitable Gambling and <br />7.62 Bingo within the Code of Ordinances, refer to Budget Committee for review and direct to <br />staff to notify licensed organizations conducting charitable gambling and direct that ordinance be <br />reviewed by the City Attorney as to form. <br /> <br />Further discussion: Councilmember Hardin felt the comments should be solicited from charitable <br />organizations. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Beyer, Cich and <br />Hardin. Voting No: None. <br /> <br />Case #8: Consider Adoption of Ordinance Regulating Premises which are <br /> Conducive to High-Risk Sexual Conduct <br /> <br />Mr. Goodrich handed out a revised copy of the proposed ordinance stating the only change is <br />"health officer" becomes "health authority". <br /> <br />Chief Auspos explained there are facilities within the City of Ramsey which have closed in booths. <br />Typically, these facilities are patronized by males, homosexual or bisexual. There are "glory <br />holes" cut into the walls of the booths to facilitate oral and anal sex. This act is found to be <br />promiscuous, unguarded and a hazardous site for the spread of AIDS. He stated he has received <br />several calls from people stating they had been at one such establishment and observed these types <br />of activities. He also received a letter from a gentleman stating he was gay and had probably 15 to <br />20 acquaintences who had tested HIV positive who have frequented a facility in Ramsey. <br /> <br />Mayor Gilbertson stated if this particular establishment is legitimate, the owner should have no <br />problem removing the doors on the booths. <br /> <br />Motion by Councilmember Cich and seconded by Councilmember Beyer to adopt Ordinance #91- <br />14 amending Chapter 5 of the City Code of the City of Ramsey by the addition of a section <br />regulating premises conducive to high-risk sexual conduct. <br /> <br />Further discussion: Councilmember Hardin stated that Council has reviewed this ordinance at least <br />three different times and he feels it is in the City's best interest to adopt an ordinance to try to <br />restrict the spread of communicable diseases. Councilmember Peterson added he had also received <br />phone calls with the suggestion to adopt this ordinance. <br /> <br />Motion carried.
