Case W/: Report on Waste Management of Minnesota, Inc. Tipping Fee <br /> Disparity <br /> <br />City Attorney Goodrich stated that Waste Management of Minnesota, Inc. (WMMI) has, since <br />January, 1990, determined that $818,265.00 of revenues are not encumbered by their obligation to <br />make a percentage payment to the City of Ramsey. This has resulted in a substantial reduction to <br />the City. Mr. Goodrich stated that he and the City Administrator met with the City of Anoka's <br />Administrator and Attorney and discussed pursuing a lawsuit against Waste Management of <br />Minnesota, Inc. He added that it will cost a fair amount of money to pursue this case. Mr. <br />Goodrich suggested serving a summons of complaint against WMMI within the next 30 days. He <br />added that he is not suggesting that the City shouldfft negotiate. He estimated the cost to serve the <br />summons of complaint to be approximately $3,000 to $5,000. He stated that the City of Ramsey <br />and the City of Anoka could start a joint account to share the cost. <br /> <br />Motion by Councilmember Cich and seconded by Councilmember Beyer to authorize the pursuit of <br />a law suit and to authorize expenditure of $3,000 to $5,000 for serving a summons of complaint <br />against Waste Management of Minnesota, Inc. with regard to their deduction of the tipping fee. <br /> <br />Further discussion: Mr. Goodrich stated that on April 9, 1991, Mr. Don Otter of WMMI, was at <br />the Council meeting and stated he would be willing to discuss this issue with the City at any time. <br />Mayor Gilbertson commented that Mr. Otter had also told him the same thing. The bills regarding <br />the law suit will be reviewed monthly with Ramsey's and Anoka's City Administrators. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Cich, Beyer and Hardin. <br />VotingNo: None. Absent: CouncilmemberPeterson. <br /> <br />Case #8: Receive Quote from City Attorney Goodrich on Codification <br /> <br />Mr. Schroeder stated that some time ago, City Council suggested receiving a quote from the City <br />Attorney on reviewing the City's Code of Ordinances to insure legal compliance and to make <br />necessary revisions to insure that the Code is in compliance. The quote received was <br />approximately $1,500.00. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Cich to authorize City Attorney <br />Goodrich to review the Code of Ordinances at an expenditure not-to-exceed $1,500.00. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Beyer, Cich and Hardin. <br />Voting No: None. Absent: CouncilmemberPeterson. <br /> <br />Case #9: Schedule a Joint Meeting with City of Anoka on Issues of Mutual <br /> Concern <br /> <br />Mr. Schroeder stated that recently the Anoka City Council had requested a meeting with the <br />Ramsey City Council to discuss a number of issues. The dates Anoka suggested were August 28 <br />or September 4. Mr. Schroeder also asked for agenda items. <br /> <br />The consensus of the Council was to plan to meet on September 4, 1991.
