<br />Mr. Sliderman stated that his client has never seen this until tonight, so they object. He stated <br />that for iuo be introduced it would have a prejudicial effect. <br /> <br />Councilmember Dehen accepted Exhibit 8. <br /> <br />City Attorney Goodrich asked Officer Katers to explain Exhibit 9, dated October 14, 2008. <br /> <br />Officer Katers stated that this is a compliance check of items at the business, which they have <br />done in the past. He stated that this occurred on the Monday after the informant sold the drill on <br />a Friday. He stated that he went to the business with his investigators and pulled five random <br />items from the shelves and asked Mr. Jerdin to provide transaction information. He stated that <br />Mr. Jerdin was able to provide APS transaction information for two of the five items. He stated <br />that one of the items Mr. Jerdin stated was purchased at a garage sale for resale, so there wasn't a <br />transaction record. Officer Katers stated that Mr. Jerdin is not authorized to be a reseller or a <br />consignment dealer. <br /> <br />Mr. Sliderman stated that he objects to all of this questioning because it is confusing testimony. <br /> <br />Officer Katers stated that there is a specific City ordinance regarding consignments or second <br />hand goods. <br /> <br />City Attorney Goodrich asked if Mr. Jerdin is a not a second hand goods dealer ifthat would be a <br />violation. <br /> <br />Officer Katers stated that it would be in violation. He stated that he did not issue citations as a <br />result of this, but did caution Mr. Jerdin on where he kept the items. <br /> <br />Mr. Sliderman stated that he objects to this Exhibit, as with the others, because there was no <br />opportunity for due process. <br /> <br />Councilmember Dehen admitted Exhibit 9 into evidence. <br /> <br />City Attorney Goodrich recalled Police Chief Way and asked about second hand goods licensing <br />and if this site has a second hand goods dealer's license. <br /> <br />Police Chief Way stated that he does not have a second hand goods license, which is different <br />from a pawn. He stated that purchasing items at a garage sale for resale is not allowed. He <br />stated that the items in the store that are used, need to have transaction papers. He stated that Mr. <br />Jerdin is allowed to sell new items, but not second hand goods. <br /> <br />Mr. Sliderman stated that they are limiting themselves to authenticity and due process tonight. <br />,He stated he questions procedure, and whether the prior owner was required to have a license to <br />sell used goods. <br /> <br />Special City Council Meeting / November 18, 2008 <br />Page 15 of 19 <br />
