He reiterated that a one-week notice is not long <br />enough. <br /> <br />Councilmember Dehen asked if Mr. Sliderman was saying that, in spite of the fact that there has <br />already been a full-blown hearing with findings that there was a number of violations, he <br />believes there has been a denial of due process. <br /> <br />Mr. Sliderman stated that it has not undergone the format that the law provides. <br /> <br />Councilmember Dehen asked all those in favor of a continuance to say aye. <br /> <br />There were no ayes. <br /> <br />Councilmember Dehen asked all those in favor of denying a continuance to say aye. <br /> <br />Mayor Gamec and Councilmembers Dehen, Look and Olson voted in favor of denying a <br />continuance. <br /> <br />Mr. Sliderman stated that because a continuance has not been granted, they would have no <br />further statements tonight. <br /> <br />City Attorney Goodrich stated that Mr. Sliderman keeps referring to the notice being 7 days and <br />today is November 18 and it was served on November 6, 2008, which is not 7 days. He noted <br />that the previous administrative hearing will not be included tonight, but will be from July 2, <br />2008 forward. <br /> <br />Mayor Gamec asked if statements from the July 2, 2008 meeting could be discussed tonight. <br /> <br />City Attorney Goodrich stated that it can be discussed, but they are not asking for any action to <br />be taken. He stated that the last Council meeting on this subject was May 27, 2008 and Mr. <br />Jerdin's license was suspended for the month of June and the incidents that will be discussed <br />tonight occurred in June. <br /> <br />Mr. Sliderman stated that perhaps what they could do is, it is still possible to continue this <br />hearing and if they wish to present their material if he could reserve the right for cross- <br />examination and questioning of what they are presenting and later present their own material. <br /> <br />Councilmember Dehen stated that this request could be made after the information has been <br />submitted. He asked City Attorney Goodrich to present his opening statement. <br /> <br />City Attorney Goodrich stated that this is a revocation hearing brought under City Code 7.13 <br />concerning a license issued by the City to Ralph's Gun and Pawn, 6101 Highway 10, Ramsey, <br />MN. He stated that the Council will hear that a letter was served on the operator, conduct a <br />hearing and also will lay out causes of evidence, so the operator had information about what was <br />being presented and full opportunity to come and review materials that the City had.
