<br />Fire Inspector Kohner stated that the International Code Council is adopted by the State and then <br />the City adopts it. He stated that Fire Chief Kapler is correct in that all "A" occupancies now <br />need to be sprinkled. <br /> <br />Councilmember Dehen asked if there was resistance to putting the sprinkler system in. <br /> <br />Fire Chief Kapler stated that they met with the owner and builder on site and are looking at <br />alternatives for the actual water source rather than having City water pumped to the site. <br /> <br />Councilmember Dehen stated that the City might have some liability if there are fire suppression <br />codes that are not being followed. He asked if the owners did not want to put in the fire <br />suppression system, because he did not understand the discussion. <br /> <br />Mr. Anderson, one of the property owners, stated that their builder was not able to attend <br />tonight's meeting. He stated that they have been trying to expand and improve the facility and <br />they had the Fire Chief look at the plans in October. He stated that he was told that if the plans <br />were reduced to 1,000 sq. ft. it could be done without sprinklers and then after they changed the <br />plans they were told the whole thing would still have to be sprinklered, regardless of its size. He <br />stated that he was upset that they went through this extra expense so he contacted Mayor Gamec. <br />He stated that this restriction throws a lot of cold water on the project, such as requiring them to <br />sprinkle a pavilion. He stated that they were trying to work with the City to come up with a <br />solution to reduce the costs of doing this project, which is where it stands right now. <br /> <br />Councilmember Elvig stated that he understands the need for a sprinkled building with the <br />cooking, alcohol and people, but asked how about a pavilion and how you keep infrastructure <br />from freezing in an outdoor atmosphere. <br /> <br />Fire Chief Kapler stated that the City can help design that, for example, parking ramps can be <br />sprinkled in Minnesota, they just need a dry system. <br /> <br />Fire Inspector Kohner stated that a pavilion in a park area is excluded from this requirement. <br /> <br />Mr. Anderson stated that his suggestion is for the Council to approve this and put a stipulation <br />that they work on a fire suppression system with the staff. <br /> <br />Fire Chief Kapler stated that as it sits in front of the Council, the Buil9ing Code is crystal clear <br />that it needs to be sprinkled. He stated that they have already made the offer to assist the <br />business in looking at other systems. <br /> <br />Assistant Community Development Director Frolik stated that this case is for the site plan, which <br />is separate from Building Code issues. <br /> <br />City Attorney Goodrich suggested that the motion should direct staff to continue working with <br />the applicant so the required fire suppression system is constructed in as economic matter as <br />possible under the State Building Code and State Fire Code. <br /> <br />City Council / December 9, 2008 <br />Page 8 of 17 <br />
