Case #2: Request for a Conditional Use Permit for an Outside Display/Sales <br /> Area; Case of Jim Provinzino <br /> <br />Zoning Administrator Frolik stated that Mr. Jim Provinzino is proposing to establish a motor <br />vehicle sales lot at 6304 Highway #10. Mr. Provinzino's property is approximately 1/2 acre in <br />size and is zoned B-3 Highway Business. Motor vehicle sales is a permitted use in the B-3 <br />Business District; however, a conditional use permit is required if the business includes an outside <br />display/sales area. Mr. Provinzino's site plan proposed to have a maximum of 28 vehicles in the <br />outside display area. She stated the Planning and Zoning Commission conducted a public hearing <br />and is recommending approval of Mr. Provinzino's request for this CUP for outside display area. <br />They also recommended that the CUP limit the number of cars permitted to be displayed on the <br />property to a maximum of 23, establish a 10 foot setback from the front property line for the <br />display area, and that a 20 foot fire lane be maintained on the site. <br /> <br />City Council proceeded to review the findings of fact. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beyer to delete #14 from the <br />proposed findings. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Beyer, Cich and <br />Hardin. Voting No: None. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beyer to adopt Resolution <br />~g) 1-08-199 adopting findings of Fact #0301 relating to Jim Provinzino's request for a conditional <br />use permit for an outside display/sales area. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Beyer, Cich and <br />Hardin. Voting No: None. <br /> <br />City Council proceeded to review the conditional use permit. <br /> <br />The consensus of the Council was to add the phrase "except that the permit cannot be transferred <br />without the express consent of the Council" to condition #1. <br /> <br />Motion by Councilmember Cich and seconded by Councilmember Peterson to approve Mr. Jim <br />Provinzino's request and adopt Resolution g91-08-200 establishing the terms of a conditional use <br />permit, as amended, for an outside display/sales area at 6304 Highway #10 N.W. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Cich, Peterson, and Beyer. <br />Voting No: None. Abstain: CouncilmemberHardin. <br /> <br />Case #3: Request for Site Plan Approval; Case of Mike Sjoquist <br /> <br />Ms. Frolik stated that Mr. Mike Sjoquist is requesting site plan approval to construct a 1,600 <br />square foot cabinet making shop on his property at 7520 - 149th Avenue N.W. The property is <br />zoned P.U.D. and is located on Lot 4, Block 1, Pineview Estates 2nd Addition. This P.U.D. was <br />approved for development of the lots with a combination of residential and commercial uses. The <br />Planning and Zoning Commission recommended approval of the site plan with no concrete curb <br />and gutter required on the hard surfacing in order to remain more harmonious with the rest of the <br />neighborhood. <br /> <br />Motion by Councilmember Cich and seconded by Councilmember Hardin to approve Mr. Mike <br />Sjoquist's request for site plan approval contingent upon compliance with the City Staff review <br />letter dated July 31, 1991. <br /> <br />City Council/August 27, 1991 <br /> Page 5 of 8 <br /> <br /> <br />
