Motion by Councilmember Look and seconded by Mayor Ramsey to adopt Resolution <br />#09 -01 -112 designating Village Bank as official financial institution for the City of <br />Ramsey banking services for the year of 2009. <br />Motion carried. Voting Yes: Mayor Ramsey, Councilmembers Look, Dehen, Jeffrey, <br />McGlone and wise. Voting No: None. Absent: Councilmember Elvig. <br />Motion by Councilmember Look and seconded by Mayor Ramsey to adopt Resolution <br />#09 -01 -113 authorizing signatures for financial transactions. <br />Motion carried. Voting Yes: Mayor Ramsey, Councilmembers Look, Dehen, Jeffrey, <br />McGlone and wise. Voting No: None. Absent: Councilmember Elvig. <br />Case #6: Consider Improvement Project #08 -31 Bituminous Paving of <br />Chameleon Street in the Shawn Acres Subdivision <br />City Engineer Jankowski stated that this project consists of the bituminous paving of <br />Chameleon Street between 173 Avenue and 176 Lane in the Shawn Acres subdivision. <br />The improvements include grading and paving of the road and also to grade ditches <br />alongside the roadway. A public hearing was held on November 10, 2008. A petition <br />signed by 11 of the 21 benefitted property owners opposing the project was received on <br />January 5, 2009. However, one property is owned by a three party trust and a different <br />owner has signed the petition against the project than initially signed the original petition <br />for the improvements. Staff received legal opinion regarding the trust signatures and one <br />for and one against — they cancel each other out, therefore, they were not counted. There <br />are 10 who oppose the project and 9 who are in favor of the project. The City's <br />ordinance says that if there is a greater percentage opposed to a project than for a project, <br />the properties in favor of the project have 30 days to submit a counter petition in favor of <br />the project if they get more signatures. Staff is recommending that the Council accept the <br />petition, certify the number of valid signatures, and allow for a thirty -day period ending <br />January 30, 2009, for the receipt of a counter petition. <br />Councilmember Dehen suggested that this project illustrates our petitioning process quite <br />well. He inquired what the cost is to maintain dirt roads. <br />Director of Public Works Olson stated that staff did an analysis on how many dirt roads <br />we have and we spend as much per resident on dirt roads as residents on paved roads. <br />There is a significant amount of man -hours plus the dirt and odor. <br />Councilmember Dehen inquired if the primary reason the residents counter- petitioned is <br />concern of cost. <br />Director of Public Works Olson replied he was not sure but he thought that may be the <br />reason. The City offered the 50% assessment to them whereas it used to be a 100% <br />assessment the first time. <br />City Council /January 13, 2009 <br />Page 20 of 32 <br />
