<br />Zoning Bulletin <br /> <br />Preemption-Town rejects airport's application <br />for runway construction <br /> <br />, <br />" <br /> <br />Airport says town's land use powers are preempted by <br />federallaw <br /> <br />Citation: Tweed-New Haven Airport Authority v. Town of East Haven, <br />Conn., 2008 WL 4696980 (D. Conn. 2008) <br /> <br />CONNECTICUT (10/24/08)-Tweed-New Haven Airport (the "Air- <br />port") was situated on land in the town. The Airport was classified by <br />.the Federal Aviation Administration ("FAA") as a primary commercial <br />service airport. As such, it was required to hold an qperating certificate <br />under FAA regulations. In order to hold that certificate, the municipal <br />airport authority that operated the Airport (the "Authority") was re- <br />quired to have Runway SafetY Areas ("RSAs") that were acceptable to <br />the FAA. The Airport did not have standard RSAs at either end of its <br />main runway (the "Runway"). To remedy this failure, the Authority. <br />planned construction of RSAs at either end of the Runw~y (the "Proj- <br />ect"). The Project was thoroughly vetted by federal and state regulatory <br />bodies over many years.
