Mr. Goede stated that the only time he uses a chipper on site is if he is cutting his own trees. He
stated that the diseased trees are brought to Sunny Acres Park in Anoka for the winter.

Councilmember Dehen asked about the pictures of the wood on his property.

Mr. Goede stated that he brings back oak wood to his property to sell as firewood to people, so
he splits the wood.

Councilmember Dehen asked how often he ran the log splitters.

Mr. Goede stated that he runs it once or twice a week, but it is not very noisy. He noted that he
could not even hear it from the house to the woodpile. He noted that he no longer has any more
employees.

Councilmember Dehen asked why the City got complaints now about noise.

Community Development Director Miller stated that there were no documented complaints in
the past. She stated that neighbors had contacted the City to get information on home
occupations.

Councilmember Dehen asked ifthe $2,000 is adequate to remove the building.

Community Development Director stated that this is to cover attorney's fees if they do not
follow through with removing the structure.

Councilmember Dehen asked if there was a way to protect the City adequately, with relation to
costs.

City Attorney Goodrich stated that he thinks $2,000 would be adequate to get a court order.

Mayor Gamec stated that if the court ordered it to be done, the City would simply assess it to the
property.

Mr. Goede stated that it was his suggestion to tear down the existing horse barn because it is old
anyway. He stated that he plans to take it down himself, but he does not want to do it until the
stuff he has stored is taken out and moved into the new building.

Motion by Councilmember Elvig, seconded by Councilmember Strommen, to adopt Resolution
#08-'11-226, adopting Findings of Fact #0836, relating to the Applicant's request for a home
occupation permit, and adopt Resolution #08-11-227 approving the Applicant's request for a
home occupation permit based on the [mdings of fact.

Motion carried.
