<br />3. Other governmental agencies, for uses which ,are not related to public <br />safety; and <br /> <br />4. Entities providing licensed commercial wifeless teleColllnlunicatioll <br />services including cellular, personal c0111munication services (peS), <br />specialized mobilized radio (S~1R.), enhanced specialized mobilized <br />radio (ESMR), paging; and sImilar services that are marketed to the <br />general public. <br /> <br />h. Minimum Requirements <br /> <br />1. The user 111ust obtain. a lease fro111 the City, which shall take the <br />foUow~ng criteria into consideration,: <br /> <br />(a) The anten11aS or tower \\rill 110t interfere v'lith the purpose fol' <br />""hich the City owned property is intended; . <br /> <br />(b) The antennas or tower will have nO adverse impact on <br />surroundiilg private property; <br /> <br />(c) The applicant is willing to obtain adequate liability insurance and <br />commit to a lease agreement which includes equitable <br />compens~tion for the u.se Qf public land and other necesSary <br />provisions and safeguards. The fees shall be established by the <br />City Council after considering c0111parable rates in other cities, <br />potential expenses, risks to the City, and other appropriate <br />factors; <br /> <br />(d) The antennas or. tower will not interfere with other users who <br />have a higher priority as discussed in Section a; <br /> <br />(e) Upon reasonable notice, the antennas or tower m.8Y be required <br />to be removed at the user's expense; <br /> <br />(f) The applicant ll1ust reimburse the City for any costs which it <br />incurs because of the presence of the applicant's antennas or <br />towers; and <br /> <br />2. The user 111Ust obtain all necessary land use approvals, including a <br />conditional use permit from the City. <br /> <br />c. Special Requirements.
