Councilmember Dehen stated that he doesn't think it needs to be one firm that does both
servIces.

Assistant City Administrator Nelson stated that she thinks there is some value in having them at
the same firm.

Councilmember Dehen stated that he agreed but feels there are also times there would be value
in having them at separate firms.

Councilmember McGlone asked who will make the criteria for us to say what makes a good
lawyer when a hiring decision needs to be made.

Assistant City Administrator Nelson noted that on page 13 there is a pretty detailed portion that
lays this out.

Councilmember McGlone asked if an attorney has looked at the RFP or where the language of
the RFP came from.

Assistant City Administrator Nelson stated that she looked at RFPs used by other cities and took
a compilation from those documents.

Councilmember Look stated that he didn't read through this in detail, but his preference is
having a prosecution attorney that has some experience rather that someone with little or no
expenence.

Councilmember Dehen stated that the reality is when you talk about prosecution at that level; it
is basically entry-level prosecution.

Mayor Ramsey stated that he feels these issues should be discussed after the City gets the RFP's
back.

Councilmember Elvig stated that he would like to see a question raised with regard to timeliness
in the RFP.

Assistant City Administrator Nelson stated that this is outlined on the bottom of page 11 and
noted that there isn't a good tracking system right now and this is something that the City would
like to have. She stated that there could be more specific information included.

Councilmember Elvig stated that he would like it included so they know up front what the
expectation is for things like response time to the City.

Councilmember Wise stated that with Councilmember Dehen's being an attorney, he will
probably know quite a few of the people that may submit an RFP, which he feels will give the
City an advantage.

City Council Work Session / February 3, 2009
Page 12 of 15
