<br />Motion by Councilmember Jeffrey, seconded by Councilmember Elvig, to approve an on-sale, <br />Sunday and 2:00 a.m. intoxicating liquor license application for Wyatt Earp's LLC, d/b/a Wyatt <br />Earp's. <br /> <br />Motion carried. V oting Yes: Mayor Ramsey, Councilmembers Jeffrey, Elvig, Dehen, Look, and <br />Wise. Voting No: None. Absent: Councilmember McGlone. <br /> <br />Case #2: <br /> <br />Adoption of an Ordinance Repealing Section 2.05.06, Subdivision 3, Public <br />Safety Board <br /> <br />Assistant City Administrator Nelson stated that this case is to repeal a section of the City Code <br />that was recently discussed by the Council. She stated that staff was directed to bring this <br />forward because the Public Safety Board wasn't really being utilized frequently. <br /> <br />Councilmember Jeffrey asked if Police Chief Way and Fire Chief Kapler had any issues with <br />this. <br /> <br />Police Chief Way stated that it wasn't serving a real function other than to pass along <br />information, so he is fine with repealing this section of the City Code. <br /> <br />Fire Chief Kapler stated that he agreed with Police Chief Way and is also comfortable repealing <br />this Board. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Jeffrey, to adopt Ordinance #09- <br />01 Repealing Section 2.05.06, Subdivision 3, Public Safety Board. <br /> <br />A roll call vote was performed by the Recording Secretary. <br /> <br />Councilmember Jeffrey <br />Councilmember Dehen <br />Councilmember Look <br />Councilmember Wise <br />Councilmember Elvig <br />Councilmember McGlone <br />Mayor Ramsey <br /> <br />aye <br />aye <br />aye <br />aye <br />aye <br />absent <br />aye <br /> <br />Motion carried. <br /> <br />Case #3: <br /> <br />Consider Authorization of Improvement Project #08-32 Andrie Street & <br />164th Lane Street Improvement <br /> <br />City Engineer Jankowski stated that a public hearing was held on January 13,2009. <br /> <br />Councilmember Look left the Council Chambers at 7:13 p.m. <br /> <br />City Council / February 24, 2009 <br />Page 5 of 19 <br />
