City Council of City of New York, <br />2009 WL 104588 (N.Y. Sup 2009) . <br /> <br />NEW YORK (01/15/09)-East River Realty Company ("ERRC") <br />owned four tracts of land inl, the city. It sought to transform what was <br />a former industrial site into a residential and commercial development. <br />In furtherance of that objective, ERRC applied to the city's planning <br />commission (the "Commission"). ERRC asked the Commission to <br />amend city zoning text and maps and issue it special permits to allow <br />commercial and residential development on its land. <br />On December 5, 2007, at 10 A.M., the Commission held a public <br />hearing OIl ERRC's applications. Approximately 100 people attended <br />the hearing. The hearing room only had 65 seats. Those who could <br />not fit in the hearing room sat in the building's lobby.
