<br />Attachment G <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />Councilmember <br /> <br />RESOLUTION #09-04- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO LIGHTHOUSE LEARNING CENTER, LLC ALLOWING THE OPERATION OF A <br />DAYCARE FACILITY ON THE PROPERTY LOCATED AT 5900 167TH AVENUE NW, <br />BASED ON FINDINGS OF FACT #_; AND DECLARING THE TERMS OF SAME. <br /> <br />WHEREAS, Lighthouse Learning Center, LLC, hereinafter referred to as "Permitee", <br />properly applied to the City of Ramsey (the "City") for a Conditional Use Permit (the "Permit") <br />to operate a daycare facility on the on the property generally known as 5900 167st Ave NW and <br />legally described as follows: <br /> <br />The north 426.29 feet, as measured along west line, of that part of Southwest Quarter <br />of Southeast Quarter of Section 11, Township 32, Range 25 lying westerly of center <br />line of Trunk Highway No. 47, except road, subject to easementofrecord, Anoka <br />County, Minnesota <br /> <br />(the "Subject Property") <br /> <br />WHEREAS, the Planning Commission met on April 2, 2009, conducted a public hearing <br />pursuant to Section 9.03.05 of the Ramsey City Code and recommended that City Council <br />approve/deny the request for a Conditional Use Permit. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />This Permit is issued pursuant to Section 9.03.05 of the Ramsey City Code. The conditions of <br />this Permit are as follows: <br /> <br />1) That the Permittee shall be allowed to operate a daycare facility on the Subject Property, as <br />shown on the site plan dated March 2,2009 prepared by Phillip D. Johnson, herein attached <br />as Exhibit A, effective upon the date of City Council approval. <br /> <br />2) That the Permittee shall adhere to all applicable State Building and State Fire Codes <br />regarding the operation of a daycare facility. <br /> <br />3) That the Permittee shall adhere to all State Daycare Licensing Requirements. <br /> <br />4) That this Permit shall not be considered modified, altered, changed or amended in any respect <br />unless in writing and signed by the City and the Permittee. <br /> <br />5) That this Permit shall be perpetual in duration as long as the terms are herein complied with. <br />/ <br /> <br />6) That the City shall have the right to inspect the premises for compliance and safety purposes <br />at any time, upon reasonable request. <br /> <br />7) That the terms of this Permit shall be binding upon its successors and assigns. <br /> <br />12 <br />
