<br />CASE # I <br /> <br />Public Hearing <br />REQUEST FOR A CONDITIONAL USE PERMIT TO OPERATE A <br />DAYCARE CENTER IN THE B-1 aUSINESSDISTRICT: <br />Case of Lighthouse Learning Center _, <br />By: Chris Anderson, Environmental Coordinator <br /> <br />Background: <br /> <br />On March 3, 2009, the City received a request from Michelle Buisman, own~r of Lighthouse <br />Learning Center, for a conditional use permit (CUP) to operate a daycare center in the B-1 <br />Business I?istrict at the property generally known as5900 167th Ave NW. . <br /> <br />Notification: <br /> <br />In accordance with City Code, Staff attempted to notify property owners within 350 feet of the <br />property. <br /> <br />Observations: <br /> <br />Lighthouse Learning Center is currently located in a multitenant building on the north side of <br />167th Ave, just across from the subject property. The daycare's current space is approximately <br />4,000 sq. ft., which is more area than necessary for its operation. The applicant is proposing to <br />relocate the business to the multitenant building at the southeast comer of 167th Ave and TH47 in <br />a tenant space that is roughly 2,000 square feet. <br /> <br />Lighthouse Learning Center currently has twenty-two (22) kids and three (3) staff persons. They <br />are currently licensed through the MN Department of Human Services and have been now Jor <br />. five (5) years. Using the MN Department of Health's formula to determine maximum occupancy <br />for a daycare center, the proposed tenant space on the subject property would allow for roughly <br />fifty-three (53) children (1,855 sq. ft. @ 35 sq. ft. per child). However, the applicant doesn't <br />anticipate nearing that capacity level. <br /> <br />Anoka Hennepin Preschool Readiness is currently utilizing the suite that the daycare would <br />occupy. The preschool's lease expires July 31, 2009 but would likely vacate the suite after the <br />school year ends in mid June; this would allow Lighthouse Learning Center to occupy the space <br />July 1, 2009, should this request be approved. Due to the similar nature of the two businesses, no <br />remodeling work would be necessary. Furthermore, because the occupancy type is not changing <br />(it is currently, and will remain, an "E" [Education] type use), a fire suppression system is not <br />required per Section 1306 of the MN State Building Code. However, the applicant, along with <br />the building owner, does intend to install a fire detection and alarm systerri. <br /> <br />1 <br />
