<br />Mr. Hunt stated he has a wildflower garden on his property, which is a much better solution than <br />leaving an unsupervised strip of land. He indicated he thinks this is just plain a bad idea, and the <br />City has not thought it through. He stated that he thinks the Planning Commission should <br />recommend to. the City Council that they do not approve this ordinance, or put in a provision that <br />the City will buy property at market value, but do not take people's land. . <br /> <br />. Motion by Chairperson Nixt, seconded by Commissioner VanScoy, to close the public hearing at <br />8 :52 p.m. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Van Scoy, Brauer, Johnson, <br />Levine, and Shepherd. Voting No: None. Absent: Commissioner WatsQn. <br /> <br />Commission Business <br /> <br />Chairperson Nixt stated one comment Mr. Hunt made struck a nerve with him. He expressed <br />concern that the ordinance considers exceptions. <br /> <br />Commissioner Johnson asked if the buffer area is excluded from the area of the lot and Mr. <br />Gordon indicated it is not excluded. <br /> <br />Chairperson Nixt stated they may want to clarify, because if you have a 40-foot buffer area and <br />cannot meet setbacks the City may have taken away thebuildability of a lot. <br /> <br />Mr. Gordon stated there are several setbacks in play now that affect where you can build, and this <br />is just another one. <br /> <br />Commissioner Johnson agreed the ordinance does not specifically state that the. buffer does not <br />take away from the lot area. <br /> <br />Chairperson Nixt stated he thinks he would strongly consider a hardship application for anyone <br />affected by this ordinance. He asked if there is anything in the ordinance to allow the City to <br />control noxious weeds, or allow the homeowner to control them using sound judgment. <br /> <br />Zoning and Recycling Coordinator Anderson stated 9.06.04 addresses Best Management <br />Practices. <br /> <br />Mr. Gordon stated there is also a provision so if the buffer is not graded and has acceptable <br />vegetation it could remain intact as. is. <br /> <br />Commissioner Johnson clarified that if he is developing and has a wetland, and there is <br />I vegetation that comes up from that wetland, he will have to take that 25-50 feet and landscape it. <br />He asked if the ordinance does not suggest that if you have a wetland at a level that gets <br />recognized and there is a boundary around it, you should be dropping back 25 feet from that <br />existing edge and buffer. <br /> <br />Planning Commission/May 5, 2005 <br />Page 15 of 19 <br /> <br />44 <br />
