The Commission proceeded to review the conditional use permit. <br /> <br />Chairman Zimmerman asked Mr. Jeff Knutson of Glenn Rehbein Excavating, Inc. if he had any <br />questions regarding the conditions, to which Mr. Knutson replied he had none. <br /> <br />Commissioner Deemer asked Mr. Knutson if he understood the removal date for the mobile home <br />is May 1, 1993 to which Mr. Knutson replied he understood the date and had no problem with it. <br /> <br />Motion by Commissioner Deemer to modify #3 in the conditional use permit to increase the <br />proposed financial guarantee from $1,000 to $5,000 for two reasons. The reasons being: 1) <br />Rehbein has not fulfilled previous agreements with the City; and 2) $1,000 wouldn't be sufficient <br />to cover moving and legal costs if the City was forced to move the trailer. <br /> <br />Further discussion: Ms. Frolik stated that in checking, she found the cost to move a trailer 50 <br />miles was between $400 and $500. Commissioner Deemer stated that legal and impounding <br />expenses would be very costly. Mr. Jeff Knutson stated that the applicant in this case is Glenn <br />Rehbein Excavating, Inc. and has no connection with L&G Rehbein, Inc. to which Mr. Deemer is <br />referring to. Commissioner Hendriksen agreed that if it would cost $500 to move the trailer and <br />Rehbein only has to put a $1,000 deposit down, that doesn't give the City very much leverage in <br />the event the City has to take care of moving the trailer. Commissioner LaDue stated he feels <br />$5,000 is excessive. The Commission compromised the proposed financial guarantee at $3,000 so <br />that it would be sufficient to cover moving and legal costs. <br /> <br />The motion was seconded by Commissioner Bawden to increase the proposed financial guarantee <br />to $3,000. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, Bawden, <br />Hendriksen and LaDue. Voting No: None. Absent: Commissioners Terry and Thorud. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner Bawden to add #5 in the <br />conditional use permit to read "All City costs incurred in administering and enforcing this permit <br />shall be the responsibility of the permit holder". <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, Bawden, <br />Hendriksen and LaDue. Voting No: None. Absent: Commissioners Terry and Thorud. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Bawden to recommend that <br />City Council approve Glenn Rehbein, Inc's. request for a conditional use permit, as amended, <br />based on the findings of fact. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, Bawden, <br />Hendriksen and LaDue. Voting No: None. Absent: Commissioners Terry and Thorud. <br /> <br />Case #4: Request to Vacate Dedicated Street Right-of-Way in Gateway North <br /> Industrial Park <br /> <br />Mr. Jankowski feels that the persons proposing this vacation are doing so strictly for economic <br />reasons. He added that on the positive side for vacation, all lots served by the street system <br />proposed to be vacated will continue to have legal access; however, lots along 143rd Avenue <br />N.W., Jaspar Street N.W. and the remaining portion of 142nd Avenue N.W. would be serviced <br />by 2100 feet of dead end street. Planning efforts have identified a future outlet to the east for this' <br />industrial area but on the negative side, plans aren't always realized. The proposed vacation would <br />cause utilities such as gas, electric, water and telephone, which are normally looped, to either be <br />decreased in flexibility or require greater costs because of the need to be "doubled back" along the <br /> <br />Planning & Zoning Commission/May 7, 1991 <br /> Page 6 of 10 <br /> <br /> <br />
