Case ~9: Review Terms of Conditional Use Permit Issued to Ramsey Auto
Sales at 7205 Highway #10 N.W.; Case of Robert Wojcik

Commissioner Hendriksen stated there is a real concern that Mr. Wojcik is conducting a salvaging
operation and it is clearly spelled out in Item #6 of his conditional use permit that this use is
prohibited. He stated he observed salvage vehicles being brought into Mr. Wojcik's place of
business just this past week, which was after the discussion with Mr. Wojcik at the April Planning
and Zoning Commission where he was specifically told that salvaging vehicles was prohibited with
his current conditional use permit.

Commissioner Deemer asked to go on record as saying he is not happy with the situation at
Ramsey Auto Sales and that Mr. Wojcik always disregards rules and terms.

Upon inquiry, Ms. Frolik stated that City Code requires City Council to conduct a public hearing
to revoke a conditional use permit.

Motion by Commissioner Hendriksen and seconded by Commissioner Deemer to recommend that
City Council take the necessary steps to revoke Mr. Wojcik's conditional use permit based on the
evidence received and observed and that the permit holder has and continues to violate Item #6 of
his conditional use permit.

Motion carried. Voting Yes: Chairman Zimmerman, Commissioner Hendriksen, Deemer,
Bawden and LaDue. Voting No: None. Absent: Commissioner Terry and Thorud.

Case #3:

Request for a Conditional Use Permit to Have a Temporary Mobile
Home Residence at Northfork Links Golf Course Construction Site;
Case of Glenn Rehbein Excavating, Inc.

Ms. Frolik stated that Glenn Rehbein Excavating, Inc. has applied for a conditional use permit for
the use of a mobile home, in addition to a construction trailer, on the subject property for security
purposes and to monitor critical issues relating to the golf course construction. The project
superintendent and his wife would reside in the home until the project is complete, approximately
two years. On April 23, 1991, the City Council granted temporary permission for Glenn Rehbein
Excavating, Inc. to move the mobile home onto the property for security reasons until a decision
has been made on the application for the conditional use permit. The applicant was also required to
deposit $1,000 with the City to guarantee removal of the trailer if the conditional use permit was
denied.

The Commission proceeded to review the proposed findings of fact.

Motion by Commissioner Deemer and seconded by Commissioner LaDue to modify #'s 9, 10, 11,
12 and 13 in the affirmative manner.

Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, LaDue, Bawden
and Hendriksen. Voting No: None. Absent: Commissioners Terry and Thorud.

Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to recommend that
City Council adopt the proposed findings of fact, as amended, relating to Glenn Rehbein, Inc's
request for a conditional use permit for a temporary mobile home.

Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, Hendriksen,
Bawden and LaDue. Voting No: None. Absent: Commissioners Terry and Thorud.

Planning & Zoning Commission/May 7, 1991
