Motion by Commissioner Bawden and seconded by Commissioner Terry to recommend that City <br />Council grant preliminary plat approval to Northfork Point contingent upon compliance with the <br />City Engineer's review dated May 2, 1991 and a favorable report from DNR. Also, that the <br />developers be allowed to rename the street to something beginning with the letter 'Y' and that no <br />variance to the 31 feet of pavement width be granted. <br /> <br />Motion carded. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, LaDue, <br />Deemer, Thorud, Terry and Bawden. Voting No: None. <br /> <br />Case #8: Discussion Regarding Development Standards For Pineview Estates <br /> 2nd Addition Planned Unit Development (PUD): <br /> <br />Sylvia Frolik explained that in 1987, Council granted final plat approval to Pineview Estates 2nd <br />Addition. The plat consists of 10 dual purpose lots fronting on 149th Avenue N.W. The lots were <br />approved to be developed with a combination of residential and commercial uses. Documentation <br />relating to the plat is very explicit regarding the standards for the residential portions of the lots but <br />the standards to be imposed on the commercial portions of the lot are not clear. Sylvia <br />recommended that since the plat was extracted from Industrial zoning, that any issues not <br />addressed in the plat documents be resolved using the Site Plan and I-1 Industrial zoning <br />regulations from City Code. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Bawden to recommend that <br />Section 9.03.06 (Site Plan Review) and Section 9.21.26 (I-1 Industrial District) be utilized to <br />regulate development of the commercial portion of the lots in Pineview Estates 2nd Addition. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners LaDue, Bawden, <br />Hendriksen, Terry, Deemer and Thorud. Voting No: None. <br /> <br />Case #10: <br /> <br />Proposed Ordinance To Amend City Code To Increase Accessory <br />Structure Height Limits In The R-I Rural Residential Area: <br /> <br />Sylvia Frolik stated that per the Commission's direction, an ordinance has been drafted to amend <br />the accessory structure height limit in the Rural Residential area from 16 feet to 22 feet. <br /> <br />Peter Nieder - Stated that amending the height limit to 22 feet will mean that on some properties, <br />the accessory structure height could exceed that of the home. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner Bawden to recommend that <br />the City Council adopt the proposed ordinance amendment to increase accessory structure height <br />limits to 22 feet. <br /> <br />Further Discussion: Commissioner Deemer stated that maybe height limits should graduate based <br />on the size of the lot. Commissioner Hendriksen replied that the accessory structure size limits are <br />on a graduated scale and will dictate reasonable accessory structure heights on the smaller rural <br />lots. <br /> <br />Motion carded.
