Mr. Brand stated they don't want the property vacated until this money shows up as this is the
resident's insurance policy.

Commissioner Deemer stated the money was spent to buy a park for the residents.

Becky Dehn, 17513 Wolverine St. N.W., Ramsey - stated that the original plat shows the land as
dedicated park lots to the City. The error was that the township didn't get the deed.

Vice-Chairman Hendriksen agreed that a lot of events happened that should not have happened;
however Lot 9, Block 2, Windsorwood Addition was obtained to replace the parkland that was
inadvertently built upon.

Mr. Brand stated that the residents don't want the property vacated until they see some money for
park development.

Ms. Dehn stated that three years ago she talked to Wright Title and asked how they could give
insurance to a house when it is stated the property it is on is an outlot dedicated as a park and they
told her they didn't have a problem with it. She stated they want the land vacated to cover up their
mistakes.

Vice-Chairman Hendriksen stated that the City can't do anything now about what was done in the
past except to try to come up with the best alternative to rectify the errors.

Ms. Dehn stated that Wright Title wants the City to vacate its interest and she feels that the title
company should have to take some responsibility.

Vice-Chairman Hendriksen stated that several people have made mistakes and he doesn't feel that
the title company is the one that should be solely responsible; he feels it is incumbent upon
everyone involved to take care of this matter.

Ms. Dehn stated that the residents want compensation for errors made and if the property is
vacated, Wright title gets away "Scott free" for their part of the error.

Mr. Brand stated there should be some financial restitution to the parks being proposed.

Michelle Ash, 8713 - 175th Lane N.W., Ramsey - stated she would agree to the vacation, but the
market value at the time it was sold should go into the development of the park in Sorteberg
Addition. She felt the lot in Windsorwood Addition should be sold and the proceeds should be
used to develop the park in Sorteberg.

Commissioner Deemer asked the residents if they understood that Outlot B may never have been
developed as a park anyway, as there are a lot of parklands the City cannot afford to equip.

Mr. Brand stated they realize that.

ADJOURNMENT

Motion by Commissioner Deemer and seconded by Commissioner Bawden to adjourn the public
hearing.

Motion carried. Voting Yes: Vice-Chairman Hendriksen, Commissioners Deemer, Bawden and
Thorud. Voting No: None. Absent: Chairman Zimmerman, Commissioners LaDue and Terry.

Public Hearing/P&Z/June 4, 1991
