Mr. Martinson replied that if they don',t comply with the third extension they will not be back
requesting another extension.

City Attorney Goodrich inquired as to how much would they need to implement the conditional
use permit.

Mr. Martinson replied that he was requesting one year. He did not see a downside to the City by
extending the permit.

City Administrator Norman noted that the City was not holding Mr. Shot back on development
of his property.

Councilmember Elvig stated that Mr. Shot does not have the money to construct a fence and yet
he wants to take on major redevelopment. Conversely he sold two other properties and still does
not have money to put up a fence. Then he wants a third extension from the City to let a property
sit.

Mr. Martinson replied that Mr. Shot does not currently have the money to construct the facility.

Councilmember Elvig noted that all the conditional use permit requires is the construction of a
fence.

Mr. Martinson explained that the fence has to be a concrete wall and if a new facility is
constructed a portion of the fence would have to be removed so Mr. Shot has held off on the
fence to see what possibilities would be made available by the City.

Councilmember Elvig stated that if in fact there was going to be a venture between the City and
the business owner knowing that a person can't even afford to put up a fence and looking for
potential grant or TIF funds it would be a bad venture. He felt that at this point they should
continue with what was originally agreed to and if they were willing to do that he would possibly
consider a 30-day extension to get the fence installed.

Mayor Gamec inquired if it was possible to grant the extension for a short-time.

City Attorney Goodrich replied yes, but he also noted that if the extension is denied Mr. Shot
could come back and apply for a new conditional use permit.

Mayor Gamec stated that he was leaning towards denying the request. If Mr. Shot wants to come
fbrward with a site plan for a new facility and then follow through with it they may be in
agreement, but there have been a lot of unkept promises.

Mr. Martinson replied that he did not have the ability to put that information together between
2:45 p.m. and 7:00 when he received the notice of the Planning Commission on the same day the
meeting was going to be held.

City Council/July 8, 2003

P83
