,? <br /> <br /> CHAPTER 1 <br /> ORDINANCE NO. 1.1 <br /> <br />TITLE: AN ORDINANCE CON- <br />CERNING DOGS. <br /> <br /> Section 1. Every owner or keeper <br />of a dog or animal of a dog kind, <br />within the limits of the Township <br />of Ramsey, shall cause the same <br />to be registered, numbered, des- <br />cribed and licensed in the office of <br />the toxvn clerk of said township. <br />Such license shall be for the whole <br />or unexpired portion of the year <br />ending on the ensuing first day of <br />Senuary. Such owner or keeper <br />shall pay to the town clerk for <br />such license the sum of three dol- <br />lars for male dogs or male animals <br />of a dog kind and the sum of five <br />dollars for female dogs or female <br />animals of a dog kind. <br /> <br /> Section 2. The town clerk of said <br />township shall, in the matter of <br />issuing such license, perform all <br />duties fixed by the general laws <br />of the state. He shall, at an ex- <br />pense to the licensee not exceeding <br />fifty cents each, provide and furn- <br />ish for each licensed dog or animal <br />of a dog kind a license, receipt for <br />the same and a metallic tag, upon <br />which shall be stamped or engraved <br />the register number of the dog or <br />animal of a dog kind and the year <br />when registered. <br /> <br /> Any person who shall make, soil, <br />purchase, possess, or shall place or <br />allow to be placed on any dog or <br />animal of a dog kind any metallic <br />tag of the same form, shape, or <br />intended to be like the official tag, <br />shall be guilty of a misdemeanor. <br /> <br /> In case the said metallic tag is <br />lost or stolen, the owner or keeper <br />of a dog or animal of a dog kind, <br />upon presenting and surrendering <br />to the town clerk the license or <br />receipt issued when the dog or <br />animal of a dog kind was regisfered <br />and an affidavit setting forth the <br />fact that such tag was lost or <br />stolen, shah receive a duplicate tag <br />and a duplicate license upon the <br />payment of fifty cents to the town <br />clerk. Said duplicate license shall <br />be registered, numbered, described <br />and issued as the original license. <br />Failure to present the original li- <br />cense or receipt issued will be suf- <br />ficient cause to allow the town <br />clerk to deny a duplicate license <br />or duplicate metallic tag. In such <br />case a license, as described in sec- <br />tion 1 hereof, shall be required. <br /> <br /> Section 3. The town clerk shall <br />pay over monthly to the town <br />treasurer all license and metallic tag <br />fees received by him. These funds <br />shall first be used to defray any. <br />costs incidental to the enforcement <br />of this ordinance; including, but <br />not restricted to, the costs of li- <br />censes, metallic tags and impound- <br />ing and maintenance of the dogs <br />or animals of a dog kind. <br /> <br /> Section 4. Every owner or keeper <br />of a dog or animal of a dog kind, <br />within said township, shall place <br />and keep around the neck of said <br />animal owned or kept by him, a <br />collar, on which shsll be securely <br />fixed the metallic tag above men- <br />tioned. <br /> <br /> Section 5. No person having the <br />custody or control of any dog or <br />animal of a dog kind shall permit <br />the same to go upon any street or <br />roadway in said town or to run at <br />large within the limits of said <br />township unless it wears the collar <br />and tag above described. Such dogs <br />or animals of a dog kind shall be <br />apprehended and confined in the <br />dog pound by the proper officer, <br />appoInted to enforce this ordinance, <br />or any other person. <br /> <br /> It shah be unlawful for any per- <br />son to kill or destroy any dog or <br />animal of a dog kind found run- <br />ning at large without the proper <br />license and tag within the township <br />limits contrary to the provisions <br />of this section. However, any per- <br />son may apprehend such dog or <br />animal of a dog kind and deliver <br />him to the proper officer for con- <br />finement in the dog pound. <br /> <br /> Section 6. No person shall keep <br />or suffer to be kept on his premises, <br />or on premises occupied by him <br />nor permit nor suffer to run at <br />large in said township, any dog or <br />animal of a dog kind of a ferocious <br />or vicious character, habit or dis- <br />position, even though said dog or <br />animal of a dog kind be properly <br />licensed under this ordinance. <br /> <br /> If in the reasonable belief of <br />any person or officer, appointed to <br />enforce this ordinance, such dog <br />or animal of a dog kind presents <br />an immediate danger to the health <br />and safety of any person or the <br />said township, said person or of- <br />ricer may kill said dog or animal <br />of a dog kind forthwith. Other- <br />wise said person or officer may <br />apprehend said dos or animal of <br />a dog kind and deliver hi~n to the <br />dog pound for confinement. If the <br />dog or animal of a dog kind is <br />found to present a danger to the <br />health and safety of said township, <br />based upon a reasonable belief of <br />the officer, appointed to enforce <br />this ordinance, he may be killed <br />or otherwise disposed of. In such <br />a case the owner or keeper of said <br />dog or animal of a dog kind shall <br />be liable for the maintenance costs <br />provided in section 11 hereof and <br />a charge of five dollars to dispose <br />of the dog or animal of a dog kind. <br />If said dog or animal of a dog <br />kind is found not to be a danger <br />to the health and safety of said <br />township, he may be released to <br />the owner or keeper in accordance <br />with section 11 hereof. Said dog <br />or animal of a dog kind may be <br />released to other persons in accord- <br />ance with section 12 hereof. <br /> <br /> Section 7. No owner or keeper <br />of a femele dog or female animal <br />of a dog kind shall permit or suffer <br />the same to run at large in said <br />township while the same is in heat, <br />even though properly licensed un- <br />der this ordinance. Any officer, <br />appointed to enforce this ordinance, <br />or any other person may deliver <br />said female dog or female animal <br />of a dog kind to the dog pound <br />for confinement. <br /> <br /> It shall be unlawful for any Der- <br />son to kill any female dog or fe- <br />male animal of a dog kind running <br />at large in violatton of this section. <br />However, such female dog or fe- <br />male animal of a dog kind may be <br />apprehended by any person and <br />delivered to the proper officer for <br />confinement in the dog pound. If <br />properly licensed, said dog or ani- <br />malof a dog kind may be released <br />to the owner or keeper upon the <br />payment to the town clerk of a <br />five dollar fine and in accordance <br />with section 11 hereof, or said fe- <br />male dog or female animal of a <br />dog kind may be released to any <br />person in accordance with section <br />12 hereof. <br /> <br /> Section 8. No person shall keep <br />or suffer to be kept on his premises, <br />or on premises occupied by him nor <br />nermit nor suffer to run at large <br />said township, any dog or ani- <br />mal of a dog kind which is diseased <br />so as to be a danger to the health <br />and safety of said township, even <br />though said dog or animal of a <br />dog kind be properly licensed under <br />this ordinance. <br /> <br /> Any dog or animal of a dog kind <br />reasonably suspected of such df- <br />sea.se may be apprehended and <br />confined in the dog pound by any <br />person or officer, appointed to en- <br />force this ordinance. The officer, <br />appointed to enforce this ordinance, <br />shall have a qualified veterinarian <br />examine said dog or animal of a <br />dog kind. If found to be diseased <br />in such a manner to be a danger <br />to the health and safety of said <br />township, the officer, appointed to <br />enforce this ordinance, shall cause <br />such dog or animal of a dog kind <br />to be killed and shall properly dis- <br />pose of the remains. The owner or <br />keeper of said dog or animal of a <br />dog kind killed under this section <br />shall be liable for a five dollar <br />fine to cover the cost of disposing <br />of the dog or animal of a dog kind <br />and a two dollar a day mainten- <br />ance charge and the costs of any <br />veterinarian examinations. <br /> <br /> If said dog or animal of a dog <br />kind upon examination is not found <br />to be diseased within the meaning <br />of this section then said dog or <br />animal of a dog kind shall be re- <br />leased to the owner or keeper free <br />of any charge. <br /> <br /> Section 9. Whenever any dog or <br />animal of a dog kind within the <br />township sha]l have bitten any <br />person or persons, the officer, ap- <br />pointed to enforce this ordinance, <br />shall quarantine said dog or animal <br />of a dog kind in the dog pound <br />for a period of fourteen days from <br />the date the person or persons <br />were bitten. During this period a <br />qualified veterinarian shall make <br />as many examinations of the dog <br />or animal of a dog kind as he <br />deems necessary to determine if <br />said dog or animal of a dog kind <br />iS sick or diseased so as to be a <br />danger to the health and safety <br />of said township. If said dog or <br />animal of a dog kind is found to <br />be sicked or diseased the proper <br />authorities, as provided by law, <br />shall take possession of the dog or <br />animal of a dog kind to determine <br />whether or not the same is suffer- <br />ing from rabies. <br /> <br /> If said dog or animal of a dog <br />kind is found to have rabies or is <br />otherwise diseased or sick so as <br />to be a denger to the health and <br />safety of said township, he ~vill be <br />killed, and the owner or keeper <br />of the dog or animal of a dog kind <br />shall be liable for a fine of five <br />dollars to cover the cost of dis- <br />(~osing of the dog or animal of a <br />og kind and mamtenance costs of <br />two dollars per day while the dog <br />or animel of a dog kind is confined <br />in the dog pound and the costs of <br />all veterinarian examinations. <br /> <br /> If said dog or animal of a dog <br />kind is found not to have rabies or <br />otherwise diseased or sick so as <br />to be a danger to the health and <br />safety of said township, the same <br />may be released to the owner or <br />keeper upon the payment of all <br />costs of veterinarian examinations <br />and in accordance with section 11 <br />hereof. <br /> <br /> Section 10. The town board is <br />hereby authorized to appoint an <br />officer, title to be decided upon, to <br />enforce the provisions of this ordi- <br />nance. In said officer's duty of en- <br />forcing the provisions of this ordi- <br />nance, he may from time to time, <br />with the contest of the town- <br />board, designate certain assistants. <br /> <br /> The town board shall designate <br />a place for the dog pound and <br />cause its location to be known to <br />the public. <br /> <br /> Section 11. Ail dogs or animals <br />of a dog kind conveyed to the dog <br />pound shall be kept, with kind <br />treatment and sufficient food and <br />water for their comfort, at least <br />seven days, unless sooner reclaim- <br />ed by their owners or keepers, es <br />herein provided. In case the owner <br />or keeper shall desire to reclaim <br />the said dog or animal of a dog <br />kind from the dog pound, the fol- <br />lowing shall be required, unless <br />otherwise provided for in this ordi- <br /> <br /> 1. Payment of a two dollar re- <br /> and <br /> <br /> 2. If dog or animal of a dog kind <br /> is unlicensed, payment of reg- <br /> ular license fee is required, and <br /> <br /> 3. iViaJntenance costs of two dol- <br /> lars per day or any part of <br /> day while dog or animal of a <br /> dog kind is in said pound. <br /> <br /> Section 12. At the expiration of <br />seven days from the time any .dog <br />or animal of a dog kind is im- <br />pounded, if the same has not been <br />reclaimed in accordance with the <br />provisions of this ordinance, the <br />officer, appointed to enforce this <br />ordinance, may let any person <br />claim said dog or animal of a dog <br />kind by complying with all pro- <br />visions of this ordinance, including <br />section 11, or he may sell the dog <br />or animal of a dog kind to the <br />University of Minnesota, or he <br /> <br /> <br />
