<br /> AN ORDINANCE PROVIDING FOR THE
<br /> LICENSING OF DOGS
<br /> AND
<br />REGULATING THE KEE PING OF DOGS AND CATS
<br />
<br /> DOG CONTROL
<br />
<br />The Town'~rd of the Township of Ramsay, Min-
<br />nesota ordains~
<br />Section 1 ~
<br /> This ordinance shelve known as the "Dog Or-
<br />
<br />Section 2 ~,
<br /> As used in the ordinance unles~he context otherwise
<br />,n(~rca tes,~
<br /> A. "Dog"shall be intended to mea~both male and
<br /> female.~
<br /> B. "Owner" shall be intended to mean any person or
<br /> persons, firm,association or corporation owning,~J
<br /> keeping or harboring a dog. / *i
<br /> C. "Al Large" shall be intended to mean o tf~.~
<br /> premises of the owner and not under the custody-~-nd
<br /> control of the owner or other person either by leash,
<br /> cord, chain or otherwise.
<br />
<br />Section 3 RUNNING AT LARGE PROHIBITED
<br /> It shall be unlawful for any person who owns, her.
<br />bors, or keeps a dog or the parents or guardians of any
<br />such person under 2t years of age, to allow such dog to
<br />run at large.
<br />
<br />Section 4
<br /> Dogs on a leash accompanied by a responsible
<br />person or accompanied by and under the control and
<br />direction of a responsible person so as to be effectively
<br />restrained by command as by leash shall be permitted
<br />in streets or on public land unless the Township has
<br />posted an area with signs reading "Dogs Prohibited"
<br />
<br />Section 5 LICENSE REQUIRED
<br /> All dogs,'kept, harbored, or mainlained by their
<br />owners in the Township of Ramsay shall be licensed
<br />and registered if over 6 months of age. Dog licenses
<br />shall be issued by the Township Clerk upon payment of
<br />a license fee of $3.00 for each male or spayed female,
<br />and $5.00 for each unspayed female. License fees shall
<br />not be prorated. The owner shall state at the time
<br />application is made for such license and upon forms
<br />provided for such purpose his name and address, and
<br />the name, breed, color and sex of each dog owned or
<br />kepi by him. Every application for a license shall be
<br />accompanied by a certificate from a Hcensed
<br />veterinarian, showing that the dog to be licensed has
<br />been given a vaccine with llve serum against rabies
<br />within six months prior to the date of application.
<br />Every application for a license for a spayed female dog
<br />shall be accompanied with a statement from a licensed
<br />veterinarian indicating thai the dog has been spayed
<br />and giving the dale of the operation. The license shall
<br />expire on the 31st day of May in each odd numbered
<br />year. A license shall not be required for dogs less than 6
<br />months of age.
<br />
<br />Section 6
<br /> Upon payment of lhe license fee, the clerk shall issue
<br />to the owner a license certificate and metallic t,-g for
<br />each dog licensed. The shape of the tag shall be
<br />changed biannually and shall have stamped thereon
<br />the year from which it was issued and the number
<br />corresponding with the number on the certificate.
<br />Every owner shall be required to provide each dog with
<br />a collar to which the license tag must be affixed, and
<br />shall see that the collar and tag are constantly worn. In
<br />case a dog tag is lost or deslroyed, a duplicate will be
<br />issued by the clerk upon presentation of a receipt
<br />showing the payment of the license fee for the current
<br />year, and paymen) of one dollar ($1.00) fee for each
<br />duplicate. Dog fags shall not be transferable from one
<br />dog to another and no refunds shah be made on any dog
<br />license fee or tag because of death of a dog or lhe
<br />owner's leaving the Township before lhe expiration of
<br />the license period.
<br />
<br /> The provisions of this section shall not be intended to
<br />apply to dogs Whose owners are non-residents tem-
<br />porarily within the Township nor to dogs brought into
<br />fha Township for fha purpose of participating in any
<br />dog show nor shall this provision apply to "seeing-eye"
<br />dogs properly trained to assist blind persons for the
<br />purpose of aiding them in going from pl~:e, fo place.
<br />
<br />Seclion 7
<br /> The Town Clerk shall pay over monthly to the Town
<br />Treasurer all license and metallic tag fees received
<br />by him. These funds shall first be used to defray any
<br />costs incidental to the enforcement of 1his ordinance;
<br />including, but not reslricted to, the costs of licenses,
<br />metallic tags and impounding and maintenance of the
<br />dogs or animals of a dog kind.
<br />
<br />Section 8 IMPOUNDING AND POUNDMASTER
<br /> The proper officer appointed to enforce this or-
<br />dinance shall impound any dog fo'~'~d unlicensed or
<br />running at large and shall bive .~,)tice of the im-
<br />pounding to the owner of such dog if Known. In case the
<br />owner is unknown, such officer shall post notice at the
<br />Town Hall that if the dog is not claimed within 7 days of
<br />the posting of the notice, it will be disposed of.
<br />
<br /> All dogs or animals of a dog kind conveyed to the dog
<br />pound shall be kept, with kind treatment and sufficient
<br />fo~d and water for their comfort, at least seven days,
<br />unless sooner reclaimed by their owners or keepers, as
<br />herein provided. In case the owner or keeper shall
<br />desire to reclaim the said dog or animal of a dog kind
<br />from the dog pound, the following shall be required,
<br />un, otherwise provided for in this ordinance:
<br /> ~1. P'~ment of a Five ($5.00) Dollar release fee, and
<br /> 2,~dog or animal of a dog kind is unlicensed,
<br /> payment of a regular license fee is required and
<br /> 3. Maintenance costs of two ($2.00) Dollars per day
<br /> or any part of day while dog or animal of a dog kind is
<br /> in said pou .~
<br />Section 9
<br /> At the expJral~J~lbf seven days from the time any
<br />dog or animal of a dog, l~.~d is impounded, if the same
<br />has not been reclajrne~j in accordance with the
<br />provisions of this ord/~e, the officer, appointed to
<br />enforce this ordinance, may let any person claim said
<br />dog or animal of a dog kind ~jy complying with all
<br />provisions of this ordinance, inj~luding section 8, or he
<br />may sell the dog or animaJ~'of a dog kind to the
<br />University of Minnesota, or hJ~j,~ay cause such dog or
<br />animal of a dog kind to be kilT'~ and shall properly
<br />dispose of the remains thereof. Any rrj~s collected
<br />under this section shall be payable to Me Town Clerk,
<br />who shall monthly pay said monies o~er to the Town
<br />Treasurer.
<br />
<br />Section 10
<br /> Except as otherwise provided in this ordinJnce, it
<br />shall be unlawful to kill, destroy or otherwis~ caLJ~J~
<br />any injury to any dog or animal of a dog kind. Violat~n
<br />of this section ~hall constitute a misdemeanor.
<br />
<br />Section 11
<br /> No person shall keep or suffer to be kept on his
<br />premises, or on the premises occupied by him nor
<br />permit nor suffer to run at large in said township, any
<br />dog or animal of a dog kind of a ferocious or vicious
<br />character, habit or disposition, even though said dog or
<br />animal of a dog kind be properly licensed under this
<br />ordinance.
<br />
<br /> It in the reasonable belief Of any person or officer,
<br />appointed to enforce this ordinance, such dog or
<br />animal of a dog kind presents an immediate danger to
<br />the health and safety of any person or the said town-
<br />ship, said person or officer may kill said dog or animal
<br />of a dog kind forthwith. Otherwise said person or of-
<br />ficer may apprehend said dog or animal of a dog kind
<br />and deliver him to the dog pound for confinement. If
<br />the dog or animal of a dog kind is found to present a
<br />danger to the health and safety of said township, based
<br />upon a reasonable belief of the officer, appointed to
<br />enforce this ordinance, he may be killed or otherwise
<br />dispqsed of. In such a case the owner or keeper of said
<br />dog or animal of a dog kind shall be liable for the
<br />maintenance costs provided in section 8 hereof and a
<br />charge of five ($5.00) dollars to dispose of the dog or
<br />animal of a dog kind. If said dog or animal of a dog kind
<br />is found not to be a danger fo the health and safety of
<br />said township, he may be released to the owner or
<br />
<br />keeper in accordance with section 8 hereof. Said dog or
<br />animal of a dog kind may be released to other persons
<br />in accordance with section 9 hereof.
<br />
<br />~ection 12
<br /> Noowner or keeper eta femaledog or female animal
<br />of a dog kind shall permit or suffer the same to run at
<br />large in said township while the same is in heat, even
<br />though properly licensed under this ordinance· Any
<br />officer, appointed to enforce this ordinance, or any
<br />other person may deliver said female dog or female
<br />animal of a dog kind to the dog pound for confinement.
<br /> It shall be unlawful for'any person to kill any female
<br />dog or female animal of a dog kind running at large in
<br />violation of this section. However, such female dog or
<br />female animal of a dog kind may be apprehended by
<br />any person and delivered to the proper officer for
<br />confinement in the dog pound. If properly licensed,
<br />said dog or animal of a dog kind may be released to the
<br />owner OF keeper upon the payment to the Town Clerk, of
<br />a five ($5.00) and in accordance with section 8 hereof,
<br />al' said female dog or female animal of a dog kind may

<br />hereof.
<br />
<br />Section 13
<br /> Ne.person shall keep or suffer to be kept on his
<br />premises, or on premises occupied by him nor permit
<br />nor suffer to run at large in said township, any dog or
<br />animal of a dog kind which is diseased, so as to be a
<br />danger to the health and safety of said township, even
<br />though said dog or animal of a dog kind be properly
<br />licensed under this ordinance.
<br />
<br /> Any dog or animal of a dog kind reasonably
<br />suspected o~ such disease may be apprehended and
<br />confined in the dog pound by any person or officer,
<br />appointed to enforce this ordinance. The officer, ap-
<br />pointed to enforce this ordinance, shall have a qualified
<br />veterinarian ex.~.nine said dog or animal of a dog kind.
<br />If found to be diseased in such a manner to be a danger
<br />to the health and safety_ of said township, the of-
<br />ficer, appointed 1o enfo~.ce this ordinance shall cause
<br />such dog or animal of a dog kind to be killed and shall
<br />properly dispose of the r~mains. The owner or keeper
<br />of said dog or animal of a dog kind killed under this
<br />section shall be liable for a five ($5.00) dollar fine to
<br />cover the cost of disposing of fha dog or animal of a dog
<br />kind and a two ($2.00) dollar a day maintenance charge
<br />and the costs of any veterinarian examinations.
<br />
<br /> If said dog or animal of a dog kind upon examination
<br />is not found to be diseased within the meaning of this
<br />section then said dog or animal of a dog kind shail be
<br />released to the owner or keeper free of 'any charge.
<br />
<br />Section 14
<br /> Whenever any dog or animal of a dog kind within the
<br />township shall have bitten any person or persons, the
<br />officer, appointed to enforce this ordinance, shall
<br />quarantine said dog or animal of a dog kind in the dog
<br />pound for a period of fourteen days from the date the
<br />person or persons were bitten. During this period a
<br />qualified veterinarian shall make as many
<br />examinations of the dog or animal of a dog kind as he
<br />deems necessary to determine if said dog or animal of
<br />a dog kind is sick or diseased so as to be a danger to the
<br />health and safety of said township. If said dog or
<br />animal of a dog kind is found to be sick or diseased, the
<br />proper authorities, as provided by law, shall take
<br />possession of the dog or animal of a dog kind fo
<br />determine whether or not the same Js suffering fron~
<br />rabies.
<br />
<br /> If said dog or animal of a dog kind is found to.have
<br />rabies or is otherwise diseased or sick so as to be a
<br />danger to the health and safety of said township, he will
<br />be killed and the owner or keeper of the dog or animal
<br />of a dog kind shall be liable for a fine of five ($5.00)
<br />dollars to cover the cost of disposing of the dog or
<br />animal of a dog kind and maintenance costs of two
<br />($2.00) dollars per day while the dog or animal of a dog
<br />kind is confined in the dog pound and the costs of all
<br />veterinarian examination, If said dog or animal of a
<br />dog kind is found not to have rabies or otherwise
<br />diseased or sick so as to be a danger to the health and
<br />safety of said township, the same may be released to
<br />the owner or keeper upon payment of all costs of
<br />veterinarian examinations and in accordance with
<br />section 9 hereof.
