TOWNSHIP OF RAMSEY COUNTY OF ANOKA STATE OF MINNESOTA AN ORDINANCE PROVIDING FOR THE LICENSING OF DOGS AND REGULATING THE KEE PING OF DOGS AND CATS DOG CONTROL The Town'~rd of the Township of Ramsay, Min- nesota ordains~ Section 1 ~ This ordinance shelve known as the "Dog Or- Section 2 ~, As used in the ordinance unles~he context otherwise ,n(~rca tes,~ A. "Dog"shall be intended to mea~both male and female.~ B. "Owner" shall be intended to mean any person or persons, firm,association or corporation owning,~J keeping or harboring a dog. / *i C. "Al Large" shall be intended to mean o tf~.~ premises of the owner and not under the custody-~-nd control of the owner or other person either by leash, cord, chain or otherwise. Section 3 RUNNING AT LARGE PROHIBITED It shall be unlawful for any person who owns, her. bors, or keeps a dog or the parents or guardians of any such person under 2t years of age, to allow such dog to run at large. Section 4 Dogs on a leash accompanied by a responsible person or accompanied by and under the control and direction of a responsible person so as to be effectively restrained by command as by leash shall be permitted in streets or on public land unless the Township has posted an area with signs reading "Dogs Prohibited" Section 5 LICENSE REQUIRED All dogs,'kept, harbored, or mainlained by their owners in the Township of Ramsay shall be licensed and registered if over 6 months of age. Dog licenses shall be issued by the Township Clerk upon payment of a license fee of $3.00 for each male or spayed female, and $5.00 for each unspayed female. License fees shall not be prorated. The owner shall state at the time application is made for such license and upon forms provided for such purpose his name and address, and the name, breed, color and sex of each dog owned or kepi by him. Every application for a license shall be accompanied by a certificate from a Hcensed veterinarian, showing that the dog to be licensed has been given a vaccine with llve serum against rabies within six months prior to the date of application. Every application for a license for a spayed female dog shall be accompanied with a statement from a licensed veterinarian indicating thai the dog has been spayed and giving the dale of the operation. The license shall expire on the 31st day of May in each odd numbered year. A license shall not be required for dogs less than 6 months of age. Section 6 Upon payment of lhe license fee, the clerk shall issue to the owner a license certificate and metallic t,-g for each dog licensed. The shape of the tag shall be changed biannually and shall have stamped thereon the year from which it was issued and the number corresponding with the number on the certificate. Every owner shall be required to provide each dog with a collar to which the license tag must be affixed, and shall see that the collar and tag are constantly worn. In case a dog tag is lost or deslroyed, a duplicate will be issued by the clerk upon presentation of a receipt showing the payment of the license fee for the current year, and paymen) of one dollar ($1.00) fee for each duplicate. Dog fags shall not be transferable from one dog to another and no refunds shah be made on any dog license fee or tag because of death of a dog or lhe owner's leaving the Township before lhe expiration of the license period. The provisions of this section shall not be intended to apply to dogs Whose owners are non-residents tem- porarily within the Township nor to dogs brought into fha Township for fha purpose of participating in any dog show nor shall this provision apply to "seeing-eye" dogs properly trained to assist blind persons for the purpose of aiding them in going from pl~:e, fo place. Seclion 7 The Town Clerk shall pay over monthly to the Town Treasurer all license and metallic tag fees received by him. These funds shall first be used to defray any costs incidental to the enforcement of 1his ordinance; including, but not reslricted to, the costs of licenses, metallic tags and impounding and maintenance of the dogs or animals of a dog kind. Section 8 IMPOUNDING AND POUNDMASTER The proper officer appointed to enforce this or- dinance shall impound any dog fo'~'~d unlicensed or running at large and shall bive .~,)tice of the im- pounding to the owner of such dog if Known. In case the owner is unknown, such officer shall post notice at the Town Hall that if the dog is not claimed within 7 days of the posting of the notice, it will be disposed of. All dogs or animals of a dog kind conveyed to the dog pound shall be kept, with kind treatment and sufficient fo~d and water for their comfort, at least seven days, unless sooner reclaimed by their owners or keepers, as herein provided. In case the owner or keeper shall desire to reclaim the said dog or animal of a dog kind from the dog pound, the following shall be required, un, otherwise provided for in this ordinance: ~1. P'~ment of a Five ($5.00) Dollar release fee, and 2,~dog or animal of a dog kind is unlicensed, payment of a regular license fee is required and 3. Maintenance costs of two ($2.00) Dollars per day or any part of day while dog or animal of a dog kind is in said pou .~ Section 9 At the expJral~J~lbf seven days from the time any dog or animal of a dog, l~.~d is impounded, if the same has not been reclajrne~j in accordance with the provisions of this ord/~e, the officer, appointed to enforce this ordinance, may let any person claim said dog or animal of a dog kind ~jy complying with all provisions of this ordinance, inj~luding section 8, or he may sell the dog or animaJ~'of a dog kind to the University of Minnesota, or hJ~j,~ay cause such dog or animal of a dog kind to be kilT'~ and shall properly dispose of the remains thereof. Any rrj~s collected under this section shall be payable to Me Town Clerk, who shall monthly pay said monies o~er to the Town Treasurer. Section 10 Except as otherwise provided in this ordinJnce, it shall be unlawful to kill, destroy or otherwis~ caLJ~J~ any injury to any dog or animal of a dog kind. Violat~n of this section ~hall constitute a misdemeanor. Section 11 No person shall keep or suffer to be kept on his premises, or on the premises occupied by him nor permit nor suffer to run at large in said township, any dog or animal of a dog kind of a ferocious or vicious character, habit or disposition, even though said dog or animal of a dog kind be properly licensed under this ordinance. It in the reasonable belief Of any person or officer, appointed to enforce this ordinance, such dog or animal of a dog kind presents an immediate danger to the health and safety of any person or the said town- ship, said person or officer may kill said dog or animal of a dog kind forthwith. Otherwise said person or of- ficer may apprehend said dog or animal of a dog kind and deliver him to the dog pound for confinement. If the dog or animal of a dog kind is found to present a danger to the health and safety of said township, based upon a reasonable belief of the officer, appointed to enforce this ordinance, he may be killed or otherwise dispqsed of. In such a case the owner or keeper of said dog or animal of a dog kind shall be liable for the maintenance costs provided in section 8 hereof and a charge of five ($5.00) dollars to dispose of the dog or animal of a dog kind. If said dog or animal of a dog kind is found not to be a danger fo the health and safety of said township, he may be released to the owner or keeper in accordance with section 8 hereof. Said dog or animal of a dog kind may be released to other persons in accordance with section 9 hereof. ~ection 12 Noowner or keeper eta femaledog or female animal of a dog kind shall permit or suffer the same to run at large in said township while the same is in heat, even though properly licensed under this ordinance· Any officer, appointed to enforce this ordinance, or any other person may deliver said female dog or female animal of a dog kind to the dog pound for confinement. It shall be unlawful for'any person to kill any female dog or female animal of a dog kind running at large in violation of this section. However, such female dog or female animal of a dog kind may be apprehended by any person and delivered to the proper officer for confinement in the dog pound. If properly licensed, said dog or animal of a dog kind may be released to the owner OF keeper upon the payment to the Town Clerk, of a five ($5.00) and in accordance with section 8 hereof, al' said female dog or female animal of a dog kind may I~e Fei'eased'fo ady person [r~ accordance with section 9 hereof. Section 13 Ne.person shall keep or suffer to be kept on his premises, or on premises occupied by him nor permit nor suffer to run at large in said township, any dog or animal of a dog kind which is diseased, so as to be a danger to the health and safety of said township, even though said dog or animal of a dog kind be properly licensed under this ordinance. Any dog or animal of a dog kind reasonably suspected o~ such disease may be apprehended and confined in the dog pound by any person or officer, appointed to enforce this ordinance. The officer, ap- pointed to enforce this ordinance, shall have a qualified veterinarian ex.~.nine said dog or animal of a dog kind. If found to be diseased in such a manner to be a danger to the health and safety_ of said township, the of- ficer, appointed 1o enfo~.ce this ordinance shall cause such dog or animal of a dog kind to be killed and shall properly dispose of the r~mains. The owner or keeper of said dog or animal of a dog kind killed under this section shall be liable for a five ($5.00) dollar fine to cover the cost of disposing of fha dog or animal of a dog kind and a two ($2.00) dollar a day maintenance charge and the costs of any veterinarian examinations. If said dog or animal of a dog kind upon examination is not found to be diseased within the meaning of this section then said dog or animal of a dog kind shail be released to the owner or keeper free of 'any charge. Section 14 Whenever any dog or animal of a dog kind within the township shall have bitten any person or persons, the officer, appointed to enforce this ordinance, shall quarantine said dog or animal of a dog kind in the dog pound for a period of fourteen days from the date the person or persons were bitten. During this period a qualified veterinarian shall make as many examinations of the dog or animal of a dog kind as he deems necessary to determine if said dog or animal of a dog kind is sick or diseased so as to be a danger to the health and safety of said township. If said dog or animal of a dog kind is found to be sick or diseased, the proper authorities, as provided by law, shall take possession of the dog or animal of a dog kind fo determine whether or not the same Js suffering fron~ rabies. If said dog or animal of a dog kind is found to.have rabies or is otherwise diseased or sick so as to be a danger to the health and safety of said township, he will be killed and the owner or keeper of the dog or animal of a dog kind shall be liable for a fine of five ($5.00) dollars to cover the cost of disposing of the dog or animal of a dog kind and maintenance costs of two ($2.00) dollars per day while the dog or animal of a dog kind is confined in the dog pound and the costs of all veterinarian examination, If said dog or animal of a dog kind is found not to have rabies or otherwise diseased or sick so as to be a danger to the health and safety of said township, the same may be released to the owner or keeper upon payment of all costs of veterinarian examinations and in accordance with section 9 hereof.
