Section 15 The town board is hereby aulhorized to appoinl an officer, title to be decided upon, fo enforce the provisions of'this ordinance. In said officer's duty of enforcing the provisions of this ordinance, he may from time to lime, with the consent of 1he town board, designale certain assistants. The town board shall designate a place for the dog pound and cause its location to be known lo lhe public. Section 16 All fees and charges under this ordinance shall be payable to the town clerk, who shall pay over each monlh the total hereof to the town treasurer. Section 17 The officer, appointed fo enforce this ordinance, shall keep an accurate accounl of all dogs or animals of a dog kind received at 1he pound, and of all dogs or animals of a dog kind killed or released. Sectio~ 18 No person shall in any manner molest, hinder or interfere with any person authorized by the town board to capture dogs or animals of a dog kind and convey the same to the dog pound while engaged in such oc- cupation. Section 19 Cats shall be included as controlled by this ordinance insofar as pickup, impounding and boarding is con- cerned. The licensing of cats shall not be required, nor proof of anti.rabies vaccine. All other provisions et this ordinance shall apply fo cats. Section 20 KENNELS AND DOG HOSPITALS NO person, firm or corporation shall maintain in this township a kennel or hospital where dogs are kept for sale, trained, boarded, or treated on a fee basis without securing a license therefor from the town clerk, provided, however, that the owner of not more than two female dogs kept for breeding purposes will not be said to operate a kennel. The license fee shall be $2.00 per dog annually. This fee shall be in addition to the license fee prescribed in the preceding sections for each dog kept in such kennel. This provision shall in no manner affect the operation of the building code arid zoning plan of Ramsay Township. Section 21 RESTRICTIONS ON CERTAIN DOGS a. It shall be unlawful for any person to keep or harbor a dog which habitually barks or cries between the hours of 10:00 p.m. and 6:00 a.m. It shall be unlawful for any dog owner to permit his dog to damage any lawn, garden or other property. Any dog aforesaid in this section may be impounded as provided in section 8 or a complaint may be issued by anyone against the owner o~ the dog for prosecution under this ordinance. b. Any person knowing of human being bitten by a dog or cat shall immediately notify the dog catcher or the police department and said animal shall then be confined in the pound and kept under observation for a period of 14 days before being released or disposed of. Section 22 REPEALER Ordinance 1.1 passed August 21, 1967 is hereby repealed. Section 23 PENALTY Any person, firm or corporation violating any provision of this ordinance is guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not more than $300.00 or imprisonment in the city or county jail for not more than 90 days or both. Each day such a violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder. Section 24 SEPARABILITY If any chapter, section, subsection, sentence, clause, phrase or portion of this code is for any reason held invalid or unconstitutional by any court of competent iurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof. Section 25 EFFECTIVE DATE This ordinance shah be in full force end effect from and after its passage and publication. TOWNSHIP OF RAMSEY L. O.
