<br />AN ORDINANCE TO REGULATE
<br />THE COLLECTION, DISPOSAL
<br />AND TRANSPORTING OF GAR-
<br />BAGE IN THE TOWNSHIP OF
<br />RAMSEY.
<br />
<br />    Section 1. Garbage Defined. The
<br />term "garbage" shall mean the
<br />refuse animal and vegetable matter
<br />from the kitchens, pantries, dining
<br />rooms or other parts of hotels, res-
<br />taurants, boarding houses, tenement
<br />houses, dwelling houses, public in-
<br />stitutions and market houses and
<br />private hospitals; the refuse animal
<br />matter from butcher shops; the
<br />refuse fruit and vegetables from
<br />stores and commission houses; the
<br />refuse animal and vegetable mat-
<br />ter from grocery stores, fish stores
<br />and poultry stores; and all refuse
<br />accumulation containing animal or
<br />vegetable matter that attends the
<br />preparation, use, cooking or storing
<br />of meat, fish, fowl, fruit or veget-
<br />ables and shall include such paper,
<br />sacks or other container used for
<br />garbage.
<br />
<br />    Section 2. License Required. No
<br />person, corporation, partnership,
<br />association, joint venture or other
<br />form of business venture engaged
<br />in the business of collecting, dis-
<br />posing and transporting garbage
<br />shall collect or remove garbage
<br />from any hotel, private dwelling,
<br />restaurant, grocery store or any
<br />other place in the Township of
<br />Ramsey or transport any garbage
<br />upon any public roadway in the
<br />Township of Ramsey, regardless of
<br />whether the garbage is collected
<br />and removed from within the limits
<br />of the Township of Ramsoy or with-
<br />out the limits of said Township,
<br />unless such person, corporation,
<br />partnership, association, joint ven-
<br />ture or other form of business
<br />venture has a license therefor.
<br />
<br />    Section 3. License Application and
<br />Issuance. The application for li-
<br />cense sh~.]l be made to the town
<br />clerk and shall be subscribed and
<br />sworn to by the applicant and shall
<br />contain the name and address of
<br />the proposed licensee and of the
<br />owner of the vehicle or vehicles
<br />to be used, and a desoription of the
<br />vehicle and of the tanks or eon-
<br />tethers in which the garbage is to
<br />be transported, and such other use-
<br />ful information as the town clerk
<br />may require. The town clerk may
<br />issue the license, except where
<br />expressly ordered not to do so by
<br />the town board.
<br />
<br />    Section 4. License Fee; Duration.
<br />The fee for such license shall be
<br />$25.00 per year for the first vehicle
<br />and $15.00 for each additional vehi-
<br />
<br />cle. Such license shall expire on
<br />the first day of January each year.
<br />
<br />    Section 5. Additional or Change
<br />of Equipment. Only vehicles listed
<br />on the application for license may
<br />be used. If another vehicle is to
<br />be used as a replacement for the
<br />one appearing on the application,
<br />the town clerk must be so noti-
<br />fied, and for a fee of $3.00 the
<br />town clerk will issue a permit to
<br />use such replacement vehicle. If
<br />additional vehicles are to be added,
<br />then in accordance with Section 4
<br />hereof an additional fee of $15.00
<br />must be paid.
<br />
<br />    Section 6. Identification of Vehi-
<br />cles. At the time of issuance of
<br />the license the town clerk shall
<br />issue a receipt of the license. This
<br />receipt shall be presented to any
<br />town official upon request or to
<br />any other person authorized to en-
<br />force this ordinance. A separate
<br />receipt shall be issued for each
<br />vehicle, Each licensee shall dis-
<br />plaz~ at all times in a prominent
<br />place on each vehicle licensed the
<br />name of the licensee.
<br />
<br />    Section 7. Receptacles for Trans-
<br />portation of Garbage. All recept-
<br />acles used to collect and transport
<br />garbage shall be watertight and be
<br />fitted with suitable covers. All
<br />garbage shall be loaded and trans-
<br />ported as to prevent any part of
<br />the load from falling or leaking
<br />onto any public roadway.
<br />
<br />    Section 8. Insurance. No license
<br />shall be issued and no renewal
<br />granted unless the person applying
<br />for such license shall file with the
<br />town clerk proof of the fact tha.t
<br />any vehicle to be used by the li-
<br />censee is insured against loss in
<br />the following amounts: against
<br />liability imposed by law on account
<br />of bodily injuries or death of any
<br />one person in the amount of $26,-
<br />000.00 for injury or death to two
<br />or more persons the amount of
<br />$50,000.00 (other than persons cov-
<br />ered by Workmen's Compensation
<br />Law); against liability imposed by
<br />law on account of damage to any
<br />property, except that of licensee,
<br />m the amount of $10,000.00. Such
<br />insurance policies must provide they
<br />will not be cancelled without 10
<br />days prior written notice given to
<br />the town clerk. No cancellation of
<br />a policy of insurance at the request
<br />of the named insured, or the com-
<br />pany, shall be effective until after
<br />the expiration of 10 days written
<br />notice to the town clerk. Cancella-
<br />tion of said insurance will cause
<br />an automatic suspension of the
<br />license granted hereunder. The
<br />town clerk shall decide what is
<br />adequate proof of insurance, and
<br />he does not have to accept cover-
<br />age by any insurance company not
<br />
<br />authorized to carry on business in
<br />the State of Minnesota.
<br />
<br />    Section 9. License to Haul Only
<br />Garbage. No person, corporation,
<br />partnership, association, joint ven-
<br />ture or other form of business li-
<br />censed under this ordinance shall
<br />haul ashes, rubbish, paper or other
<br />refuse in the same vehicle licensed
<br />under this ordinance,
<br />
<br />    Section 10. Inspection. All tanks,
<br />containers e.nd vehicles used under
<br />said license shall be kept in a clean
<br />and sanitary condition and shall
<br />at all times be subject to inspec-
<br />tion of any official of the township
<br />or other persons authorized to
<br />enforce this ordinance.
<br />
<br />    Section 11. Records. The town
<br />clerk shall keep a register of each
<br />license issued, the number thereof,
<br />the name of licensee, the date
<br />issued, the expiration date and the
<br />amount of the fee.
<br />
<br />Section 12. Revocation. Any                              li-
<br />cense issued hereunder may                               be
<br />revoked by the town board                                as
<br />provided by the laws of the State
<br />of Minnesota, and any violation of
<br />this ordinance shall constitute
<br />cause for revocation.
<br />
<br />    Section 13. Every person, corp-
<br />oration, paxtnership, joint venture,
<br />association or other form of busi-
<br />ness association convicted of a
<br />violation of any provision of this
<br />ordinance, in Justice of Peace
<br />Court or any other court, shall be
<br />punished b;~ a fine of not to exceed
<br />$100.00 or imprisonment for not to
<br />exceed 90 days.
<br />
<br />    Section 14. This ordinance shall
<br />take effect and be in force from
<br />and after meeting all requirements
<br />of publication and notice as re-
<br />quired by law.

<br />pursuant to the powers granted
<br />under M.S.A. 368.01 by unanimous
<br />vote of the Town Board after a
<br />complete reading and discussion
<br />by the electorate then present at
<br />a regular Town Board meeting
<br />duly called August 21, 1967.
