CHAPTER 2 ORDINANCE NUMBER 2.2 AN ORDINANCE TO REGULATE THE COLLECTION, DISPOSAL AND TRANSPORTING OF GAR- BAGE IN THE TOWNSHIP OF RAMSEY. Section 1. Garbage Defined. The term "garbage" shall mean the refuse animal and vegetable matter from the kitchens, pantries, dining rooms or other parts of hotels, res- taurants, boarding houses, tenement houses, dwelling houses, public in- stitutions and market houses and private hospitals; the refuse animal matter from butcher shops; the refuse fruit and vegetables from stores and commission houses; the refuse animal and vegetable mat- ter from grocery stores, fish stores and poultry stores; and all refuse accumulation containing animal or vegetable matter that attends the preparation, use, cooking or storing of meat, fish, fowl, fruit or veget- ables and shall include such paper, sacks or other container used for garbage. Section 2. License Required. No person, corporation, partnership, association, joint venture or other form of business venture engaged in the business of collecting, dis- posing and transporting garbage shall collect or remove garbage from any hotel, private dwelling, restaurant, grocery store or any other place in the Township of Ramsey or transport any garbage upon any public roadway in the Township of Ramsey, regardless of whether the garbage is collected and removed from within the limits of the Township of Ramsoy or with- out the limits of said Township, unless such person, corporation, partnership, association, joint ven- ture or other form of business venture has a license therefor. Section 3. License Application and Issuance. The application for li- cense sh~.]l be made to the town clerk and shall be subscribed and sworn to by the applicant and shall contain the name and address of the proposed licensee and of the owner of the vehicle or vehicles to be used, and a desoription of the vehicle and of the tanks or eon- tethers in which the garbage is to be transported, and such other use- ful information as the town clerk may require. The town clerk may issue the license, except where expressly ordered not to do so by the town board. Section 4. License Fee; Duration. The fee for such license shall be $25.00 per year for the first vehicle and $15.00 for each additional vehi- cle. Such license shall expire on the first day of January each year. Section 5. Additional or Change of Equipment. Only vehicles listed on the application for license may be used. If another vehicle is to be used as a replacement for the one appearing on the application, the town clerk must be so noti- fied, and for a fee of $3.00 the town clerk will issue a permit to use such replacement vehicle. If additional vehicles are to be added, then in accordance with Section 4 hereof an additional fee of $15.00 must be paid. Section 6. Identification of Vehi- cles. At the time of issuance of the license the town clerk shall issue a receipt of the license. This receipt shall be presented to any town official upon request or to any other person authorized to en- force this ordinance. A separate receipt shall be issued for each vehicle, Each licensee shall dis- plaz~ at all times in a prominent place on each vehicle licensed the name of the licensee. Section 7. Receptacles for Trans- portation of Garbage. All recept- acles used to collect and transport garbage shall be watertight and be fitted with suitable covers. All garbage shall be loaded and trans- ported as to prevent any part of the load from falling or leaking onto any public roadway. Section 8. Insurance. No license shall be issued and no renewal granted unless the person applying for such license shall file with the town clerk proof of the fact tha.t any vehicle to be used by the li- censee is insured against loss in the following amounts: against liability imposed by law on account of bodily injuries or death of any one person in the amount of $26,- 000.00 for injury or death to two or more persons the amount of $50,000.00 (other than persons cov- ered by Workmen's Compensation Law); against liability imposed by law on account of damage to any property, except that of licensee, m the amount of $10,000.00. Such insurance policies must provide they will not be cancelled without 10 days prior written notice given to the town clerk. No cancellation of a policy of insurance at the request of the named insured, or the com- pany, shall be effective until after the expiration of 10 days written notice to the town clerk. Cancella- tion of said insurance will cause an automatic suspension of the license granted hereunder. The town clerk shall decide what is adequate proof of insurance, and he does not have to accept cover- age by any insurance company not authorized to carry on business in the State of Minnesota. Section 9. License to Haul Only Garbage. No person, corporation, partnership, association, joint ven- ture or other form of business li- censed under this ordinance shall haul ashes, rubbish, paper or other refuse in the same vehicle licensed under this ordinance, Section 10. Inspection. All tanks, containers e.nd vehicles used under said license shall be kept in a clean and sanitary condition and shall at all times be subject to inspec- tion of any official of the township or other persons authorized to enforce this ordinance. Section 11. Records. The town clerk shall keep a register of each license issued, the number thereof, the name of licensee, the date issued, the expiration date and the amount of the fee. Section 12. Revocation. Any li- cense issued hereunder may be revoked by the town board as provided by the laws of the State of Minnesota, and any violation of this ordinance shall constitute cause for revocation. Section 13. Every person, corp- oration, paxtnership, joint venture, association or other form of busi- ness association convicted of a violation of any provision of this ordinance, in Justice of Peace Court or any other court, shall be punished b;~ a fine of not to exceed $100.00 or imprisonment for not to exceed 90 days. Section 14. This ordinance shall take effect and be in force from and after meeting all requirements of publication and notice as re- quired by law. HERBERT W. PERRY Chairman ROBERT E.
