Associate Planner Wald stated the City Engineer will be overseeing the process, and it will be <br />built in accordance with City standards. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Johnson, Brauer, Reeves, <br />Shepherd, Van Scoy and Watson. Voting No: None. Absent: None. <br /> <br />Case #2: <br /> <br />Request for a Variance to Swimming Pool Setback Requirements; Case of <br />Craig and Deborah Kosnopfal <br /> <br />Presentation <br /> <br />Associate Planner Geisler advised that Craig and Deborah Kosnopfal have applied for a five-foot <br />variance from the minimum separation between a swimming pool and a well. She stated the <br />property is located at 16300 Yolite Street NW. She further advised the Kosnopfals are <br />requesting the variance due to the fact that their contractor installed an above ground swimming <br />pool 15 feet from their well, instead of the 20 feet required by City Code. Current Code requires <br />the 20-foot distance to ensure that service vehicles are able to access the well for any needed <br />repair work. She indicated it is the opinion of the Building Inspection Division that there is <br />sufficient room on the Kosnopfal's property to accommodate this concern. She stated a below <br />ground pool located the same distance from the well could have implications for seepage into <br />well water; however since the Kosnopfal's pool is above ground, water contamination is not a <br />concern. She indicated Staff recommends the request for variance be approved. <br /> <br />Chairperson Nixt closed the regular portion of the Board of Adjustments meeting at 7:15 p.m. in <br />order to call the public hearing to order. <br /> <br />Public Hearing <br /> <br />Motion by Chairperson Nixt, seconded by Board Member Johnson to close the public hearing at <br />7:17 p.m. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Johnson, Brauer, Reeves, <br />Shepherd, Van Scoy and Watson. Voting No: None. Absent: None. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Brauer to adopt Resolution #03- <br />07-172 adopting Findings of Fact #0651 relating to Craig and Deborah Kosnopfal's request for a <br />variance to the swimming pool setback requirements on the property located at 16300 Yolite Street. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Johnson, Brauer, Reeves, <br />Shepherd, Van Scoy and Watson. Voting No: None. Absent: None. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Brauer, to approve Craig and <br />Deborah Kosnopfal's request for a variance to the swimming pool setback requirements on the <br />property located at 16300 Yolite Street, based on the findings of fact and adopt Resolution #03-07- <br />173 declaring terms of the variance. <br /> <br />Board of Adjustment/July 10, 2003 <br /> Page 4 of 5 <br /> <br /> <br />
