Chairperson Nixt closed the regular Board of Adjustment meeting at 7:06 p.m. in order to call the <br />public hearing to order. <br /> <br />Public Hearing <br /> <br />Motion by Chairperson Nixt, seconded by Board Member Johnson to close the public hearing at <br />7:07 p.m. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Johnson, Brauer, Reeves, <br />Shepherd, Van Scoy and Watson. Voting No: None. Absent: None. <br /> <br />Chairperson Nixt stated Staff has done a great job addressing the concerns of the neighbor. <br /> <br />Board Member Van Scoy asked if this arrangement is agreeable with the applicant. <br /> <br />Mr. Letendre stated this arrangement was fine. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Van Scoy to adopt Resolution <br />#03-07~170 adopting Findings of Fact #0650 relating to a request for a variance from Robert <br />Letendre to the minimum lot width requirements. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Johnson, Van Scoy, Brauer, <br />Reeves, Shepherd, and Watson. Voting No: None. Absent: None. <br /> <br />Motion by Board Member Johnson, seconded by Chairperson Nixt to approve Robert Letendre's <br />request for a variance to the lot width requirements and adopt Resolution #03-07-171 declaring <br />terms of same. <br /> <br />Mr. Tomaszewski approached the Commission indicating his concerns are still valid. He does <br />not believe there is a three foot difference from his property to the proposed lot, and asked who <br />was responsible for building the culvert, and who was responsible if his property floods. He <br />stated since the property line is so close to his house, he is concerned about traffic on the new <br />driveway. He also asked if the driveway is going to be on 171st or on Tiger Street. <br /> <br />Associate Planner Wald stated that one new driveway will be created on Tiger Street. <br /> <br />Mr. Tomaszewski stated his concern is the new driveway. <br /> <br />Chairperson Nixt asked if one driveway to one residential home is a concern. <br /> <br />Mr. Tomaszewski indicated when it is under his bedroom window, it is a concern. He also <br />expressed concern of a substandard lot next to him, and his privacy with a new driveway there. <br />He indicated water comes down Tiger Street to pond, and asked who will be responsible for the <br />culvert. <br /> <br />Board of Adjustment/July 10, 2003 <br /> Page 3 of 5 <br /> <br /> <br />
