Presentation

Management Intern Haugen stated that City Code is currently in conflict because one section
states a height of 25 foot high flag pole is allowed and another excludes flag poles from height
restrictions. He stated that Attachment B in the packet summarizes the proposed changes in this
ordinance. He stated that the proposed changes would state that the height of the flag pole could
not exceed forty feet and the flag length could not exceed 25% of the pole height, with no more
than two flags permitted. He stated that the Building Official stated that if setback requirements
are followed then a footing inspection wouldn't need to be completed, but if the setbacks are not
followed, then he recommends footing inspections. He noted that flag ordinances from other
cities are included in the packet.

Citizen Input

There was none.

Motion by Chairperson Nixt, seconded by Commissioner VanScoy, to close the public hearing.

Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Van Scoy, Brauer, Cleveland,
and Rogers. Voting No: None. Absent: Commissioners Hunt and Levine.

The public hearing closed at 8:05 p.m.

Commission Business

Chairperson Nixt called the regular meeting of the Planning Commission back to order at 8:05
p.m.

Commissioner Nixt thanked staff for research on other cities and asked what the current setback
is for flag poles.

Community Development Director Miller stated that there is no setback currently and they are
recommending a setback equal to the height of the pole. She stated that the other option would
be to have footing inspections along with lessened setbacks.

Commissioner Cleveland asked if there would be a fee for people to have their flag pole
inspected.

Community Development Director Miller stated that they would need a permit for the footings,
but whether there is a fee charged would be up to the Council.

Commissioner Cleveland stated that many times people have more than one flag on their pole
and asked if the littler flag was included in the total percentage allowed.

Planning CommissionlMarch 5, 2009
