<br />Community Development Director Miller stated that either flag cannot exceed 25% of the flag <br />pole height. <br /> <br />Chairperson Nixt stated that this is not trying to regulate the surface area of the flags, just the <br />height. He stated that he thinks it is a good regulation and if there are approved footings, he <br />thinks you should be able to put the poles in the same place as signage. <br /> <br />Community Development Director Miller stated that signs are not allowed in residential areas. <br /> <br />Commissioner Brauer stated that, as written, this would probably put most state office buildings <br />in violation of City Code because they typically have 3 flags; an American flag, a State flag and a <br />MIA flag. He stated that he would recommend this be changed to allow for 3 flags. <br /> <br />Commissioner Van Scoy stated that these will need permits so the City knows where the flags are <br />located. He stated that he thinks the Planning Commission needs to decide if they can be. put <br />right at the property line. He stated that it should be specified in the language that this requires a <br />permit and footings are required. <br /> <br />Community Development Director Miller stated that she suggests a 10 foot setback from the <br />property line if footings are required. She stated that she would need actual specs from the <br />Building Official on what heighf of pole would require footings. <br /> <br />Chairperson Nixt stated that he is comfortable with a 10 foot setback with footings in residential <br />areas and in other districts in the signage setback with proper footings. He stated that the <br />question is whether to limit the number of flags or limit the square footage. <br /> <br />Community Development Director Miller stated that the City could be silent on the flag size and <br />just have limitations on the pole and setbacks. <br /> <br />Commissioner Nixt stated that he is comfortable directing staff to come up with something <br />reasonable for these restrictions. <br /> <br />Commissioner Cleveland asked if residential would be addressed differently and suggested that it <br />specifically state that residential flag poles are excluded unless they exceed 40 feet. <br /> <br />Management Intern Haugen stated that flag poles are addressed in City Code in 9.12.03 and it <br />limits them to 25 feet. <br /> <br />Associate Planner Gladhill stated that the City inadvertently created the conflict in language <br />when the sign ordinance was written. <br /> <br />Community Development Director Miller stated that for R-1 the height would be 35 feet, which <br />would probably require footings. <br /> <br />Planning CommissionlMarch 5, 2009 <br />Page 8 of 12 <br />
