Staff anticipates this boundary will be shown further east <br />once delineated. <br />The application was forwarded to the Minnesota Department of Natural Resources (DNR) for <br />comment. The DNR finds the request generally acceptable and noted that should the applicant <br />choose to develop the property as a Planned Unit Development (PUD), final approval of a re- <br />zoning would be required to be certified by the DNR.. Although a re- zoning would not be <br />required fora high density development on the proposed Lot 1, a PUD would allow flexibility in <br />land development in order to make better use of new techniques in building design, construction <br />and land development, while preserving desirable land characteristics, open space and protection <br />of sensitive environmental features such as steep slopes, poor soils and trees. The area currently <br />zoned as R -3 is in an environmentally sensitive area along an oxbow of the Rum River and <br />includes some steep slopes of river bluff. A PUD may help preserve this river bluff. <br />Park Dedication, Trail Dedication, Stormwater Fees, Sanitary Sewer Trunk Charges and Water <br />Trunk Charges will only be required as indicated on the executed purchase agreement. Park <br />Dedication requirements were waived as part of the Purchase Agreement. <br />Recommendation: <br />Based on discussion. <br />Commission Action: <br />No action required.
