(a) A conservation easement must <br />14.2 prohibit: <br />14.3 (1) alteration of wildlife habitat and other natural features, unless specifically <br />14.4 approved by the board; <br />14s (2) agricultural crop production and livestock grazing, unless specifically approved <br />1a.6 by the board for t~i~lel}ife conservation management purposes; and <br />14.7 , <br />14.8 , , <br />14.9 <br />14.10 , , <br />14.11 {~j~ spraying with chemicals or mowing, except_ <br />14.12 was necessary to comply with noxious weed control laws erZ <br />14.13 ii for emergency control of pests necessary to protect public health; or <br />14.14 (iii) as approved by the board for conservation management purposes. <br />14.15 (b) A conservation easement is subject to the terms of the agreement provided in <br />14.16 subdivision 5. <br />14.17 (c) A conservation easement must allow repairs, improvements, and inspections <br />14.ts .necessary to maintain public drainage systems provided the easement area is restored to <br />14.19 the condition required by the terms of the conservation easement. <br />14.20 (d) Notwithstanding paragraph (a), the board must permit the harvest of native <br />14.21 grasses for use in seed production or bioenerav on wellhead protection lands elieible <br />14.22 under subdivision 2, paragraph (d). <br />14.23 Sec. 12. Minnesota Statutes 2008, section 114D.50, is amended to read: <br />14.24 114D.50 CLEAN WATER FUND. <br />14.2s Subdivision 1. Establishment. The clean water fund is established in the Minnesota <br />14.26 Constitution, article XI, section 15. All money earned by the fund must be credited to <br />14.27 the fund. <br />1a.2s Subd. 2. Sustainable drinking water account. The sustainable drinking water <br />14.29 account is established as an account in the clean water fund. <br />14.30 Subd. 3. Purpose. (a) The clean water fund may be spent only to protect, enhance, <br />14.31 and restore water quality in lakes, rivers, and streams, to protect groundwater from <br />14.32 degradation, and to protect drinking water sources by: <br />14.33 (1) providing additional grants, loans, and technical assistance to public agencies <br />14.34 and others who are participa"ting in the process of testing waters, identifying impaired <br />14 <br />
