<br />April 22, 2009 <br /> <br />Re: Improvement Project 09-11, Bituminous Overlay of Barthels Rum River Acres 2nd Addition <br /> <br />Dear Property Owner, <br /> <br />On Tuesday April 21 a signed petition requesting the rejection of the bituminous overlay project <br />scheduled for this summer was presented at the April Public Works Committee meeting. City Charter <br />allows for the rejection of any assessed project if opposed by a majority of the property owners <br />1I1volved, and it appears that a sufficient number of properties have signed the delivered petition to <br />terminate this project. <br /> <br />After discussing this development with the Public Works Committee, staff was directed to prepare this <br />letter advising the affected property owners of a City Policy which has been in place since 1993 which <br />reads as follows: <br /> <br />"(Street Maintenance) projects involving stree.ts which have had previous proposed <br />maintenance projects defeated by petition shall be ineligible to receive the City's 50% <br />contribution, if the project requires a more expensive maintenance." <br /> <br />As you are aware your neighborhood streets are currently experiencing localized failures. In addition to <br />repairing these existing failures the proposed bituminous overlay will add strength and plasticity to the <br />roadway which it needs to prevent future failures. The street was constructed in 1988 and pavement <br />deteriorates at an increasing rate as it ages. Consequently if this overlay is not applied the streets may <br />deteriorate beyond the point where a bituminous overlay would be feasible, and cause the need for the <br />pavement to be reconstructed. If this project is rejected by petition, the soonest it might be <br />reconsidered would be for the 2011 construction season due to City Charter requirements. <br /> <br />Although pavement reconstruction would also be subject to the petition review process, it is several <br />times more costly then a bituminous overlay. It requires the removal and crushing of the existing <br />pavement for use as new road base, plus replacing two courses of bituminous pavement (as opposed to <br />simply adding an additional.course associated with the proposed overlay). In addition the above <br />referenced policy would affect the City's contribution which is halfthe cost of the project. <br /> <br />-130- <br />
