<br />CASE # ) <br /> <br />PUBLIC HEARING <br />REQUEST FOR A VARIANCE TO PLATTING REQUIREMENTS <br />TO ALLOW A METES AND BOUNDS SUBDIVISION; <br />CASE OF THE CITY OF RAMSEY. <br />By: Tim Gladhill, Associate Planner <br /> <br />Background: <br /> <br />As part of the approval of the Brookfield Addition, staff was directed to pursue a re-alignment of <br />16ih Avenue. In 2007, Oakwood Land Development was given approval for a Metes and <br />Bounds subdivision by the Board of Appeals to facilitate the conveyance of right-of-way for <br />167th Avenue just west of Nowthen Boulevard. Recently, the City has completed additional <br />design work and needs to accomplish a similar process further west of the Oakwood Metes and <br />Bounds subdivision, along the re-alignment of 167th Avenue. <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff sent notification of the request for a variance to property <br />owners within 700 feet of the subject property. <br /> <br />Funding Source: <br /> <br />All staff costs associated with the review of the Application are being handled through regular <br />staff responsibilities. <br /> <br />Observations: <br /> <br />Oakwood Land Development received preliminary plat approval for Brookfield in September <br />2005. As part of the approval, the City Council directed that the extension of 16ih Avenue be <br />developed south of the Brookfield plat, rather than through the plat as indicated in the <br />Comprehensive Plan at the. time. The current Comprehensive Plan, adopted in 2001, guides <br />these parcels as Rural Developing (minimum lot size of 2.5 acres). As part of the recent <br />Comprehensive Plan Update, these parcels are proposed to be guided as Low Density Residential <br />(minimum lot size of 10,800 square feet). <br /> <br />City Code requires that any new lots be created through the platting process. A Variance to the <br />platting requirement to allow a metes and bounds subdivision, in order to provide the necessary <br />right-of-way to the City, is being proposed. City Code requires that this type of variance be heard <br />by the Board of Appeals. If approved, the metes and bounds subdivision would create 6 parcels: <br />3 for the existing homes, 3 for right-of-way. <br /> <br />In this situation, the platting requirement is a hardship and practical difficulty in that no new <br />buildable lots are being created and the future alignment of parcels is unknown.
