<br />Community Development Director Miller stated that staff is thinking that with the use of <br />Administrative tickets, the number of these hearings may increase. <br /> <br />There was discussion about the Administrative ticketing process and legislation. There was <br />discussion about the positives and negatives of having a three-person board versus hiring an <br />attorney. There was discussion about whether there is a ne.ed to have someone familiar with the <br />process and law, not just a sympathetic ear in this process. <br /> <br />Councilmember Jeffrey recommended one sitting Councilmember and two citizens to serve as <br />the Hearing Board. He suggested Councilmember Dehen to serve on this board and that the only <br />time that Councilmember Dehen would then vote on any issues as a Councilmember would be, if <br />there is a tie and then he could follow the Board recommendation. <br /> <br />Community Development Director Miller suggested that this would be called something like a <br />Board of Administrative Hearings and noted that there will still need to be a staff liaison to pull <br />together background information. <br /> <br />Councilmember Look suggested utilizing some of the candidates the Council just interviewed for <br />this Board. He stated that he would suggest Jason Tossey and Bill McGowen for the Board and <br />Jim Bendtson to serve as an alternate. He stated that he feels there should be the standard per / <br />diem payment. <br /> <br />There was a consensus by the Council to have Councilmember Dehen and Jason Tossey and Bill <br />McGowen to serve as the Board of Administrative Hearings. <br /> <br />City Administrator Ulrich stated that there should also be discussion on enforcement, especially <br />between rural and urban areas. <br /> <br />Councilmember Dehen stated that he really thinks the vehicles and trailers should be regulated <br />by number and size of parcel and allow officers to make observations about violations without <br />having to go on property. <br /> <br />Community Development Director Miller stated that they are bringing that issue back for <br />discussion along with general discussion of these issues and standards for MUSA versus more <br />rural lots. <br /> <br />There was discussion about rural lots versus MUSA lots and ways to enforce the ordinance. <br />There was discussion about common sense enforcement. <br /> <br />Councilmember McGlone stated that the City is part of the seven county metro area and he feels <br />that it should be enforced equally throughout the City and it shouldn't depend on whether <br />someone has more trees than other people do do. <br /> <br />Councilmember Wise asked if the neighbors don't care,.why the City should care. He stated that <br />he also doesn't think the police need to be looking for more work to do. He stated that he feels <br />there is a huge difference between someone,with 1.5 acres and someone with 10 or 20 acres. <br /> <br />City Council Work Session / March 31, 2009 <br />Page 2 of6 <br />
