1. City Code Compliance. The CITY approves the Site Plan conditioned on the <br />PERMITTEE developing the Subject Property in accordance with the applicable <br />provisions of City Code. <br />2. Conformance with Plan. The Site Plan shall be developed pursuant to the plans consisting <br />Site Plan, Landscaping Plan, Grading, Drainage, and Erosion Control Plan for the NAU <br />Parking Lot expansion prepared by Hakanson Anderson Associates, Inc. dated April 21, <br />2009. <br />3, Restriction on Building Size.. Based on the number of parking spaces indicated on the Site <br />Plan (64), the size of future building area is restricted to 21,333 square feet on the Subject <br />Property. Should the future building have anon-residential use on the first floor/street level, <br />parking requirements for the first floor/street level can be satisfied with on-street parking <br />spaces provided and the remaining floors would then be restricted to 21,333 square feet total. <br />This restriction shall be re-calculated with future site plans. . <br />4. Incorporation of All City Code Requirements. That the recitals above and the applicable <br />provisions of the City Charter, Subdivision Code, Zoning Code and Public Improvement <br />Code of the CITY, as amended to date hereof, are incorporated. herein by reference. <br />5. Fire Lanes. Fire lanes shall be maintained on the Site. The exact locations of these items on <br />the Site shall be as directed by the Fire Chief. The PERMITTEE herein agrees to post "No <br />Parking" signs along private streets in accordance with City Code requirements and in <br />conjunction with the instructions of the Fire Chief. • <br />6. Stormwater Management Fee. -The current Stormwater Management Fee is $4,505.00 per <br />acre. Stormwater management fee obligations will be collected when the site is fully <br />developed. <br />7. Required Improvements. The PERMITTEE shall construct and install the following .site <br />improvements on the Site in accordance with the specifications and location as shown on the <br />Site Plan. The Required Improvements are as follows: <br />a. Site grading in accordance with the Grading Plan prepared by Hakanson Anderson <br />Associates, LLC dated Apri121, 2009. <br />b. Installation of storm sewer and appurtenances. <br />c. Trunk and lateral storm drainage facilities • <br />d. Installation of bituminous driveways, parking lots, and maneuvering areas. <br />e. Installation of continuous, surmountable concrete curbing and gutter. around the <br />perimeter of all bituminous surfaces. <br />f. Installation . of Landscaping in accordance with the Landscape Plan prepared by <br />Hakanson Anderson Associates, Inc. dated Apri121, 2009. <br />g. Irrigation metering and backflow devices shall be approved as part of the Utility Plan, <br />and installed accordingly.. <br />• NAU Parking Lot Expansion <br />PSD, LLC <br />Development Permit <br />Page 3 of 9 <br />-209- <br />
