B. Section 9.12.03, Subd. 11 of the City Code is amended to read as follows: <br />Subd. 11. Flags. <br />The display of flags shall be permitted in all districts. However, the total square footage <br />area of any flag used as advertising copy or as attention getting devices for commercial <br />purposes shall be considered as permanent signage and counted towards the total <br />allowable sign area permitted by this Section for the parcel on which the flag(s) is <br />displayed. <br />The height of a flag-pole may not exceed forty (40) feet, or the building height limits for <br />the underlying zoning district where the pole is located, whichever is less. Flag-poles are <br />subject to a setback equal to the height of the flag-pole from all property lines or public <br />parking areas. <br />If engineered flag-pole footings are installed, flag-poles may be located within ten (10) <br />feet of property lines or public parking lots. A building permit must be issued prior to the <br />installation of any flag-pole with footings. Footings for flag-poles are subject to review by <br />the Building Official or his/her designee, and must meet standards based on .the <br />Minnesota .State Building Code to qualify for a ten (10) foot setback. <br />The display of flags on flag-poles may not cover more than fifty-percent of (50%) of the <br />height of the flag-pole. <br />SECTION 3. SUMMARY <br />The following is the official summary of Ordinance 09-OS-_ which has been approved by the <br />City Council of the City of Ramsey as clearly informing the public of the intent and effect of the <br />Ordinance. <br />This ordinance is intended to: <br />• Limit the height of flag-poles to the maximum building height of the underlying zoning district, <br />or forty (40) feet high, whichever is less. <br />• Require that flag-pole footings are reviewed and issued a building permit. <br />• Require a setback equal to the height of the flag-pole when proper footings are not present. <br />• Require a ten (10) foot setback for flag-poles when proper footings are present. <br />• Prevent flags from covering more than fifty-percent (50%) of a flag-pole. <br />Ordinance #09-OS <br />Page 2 of 3 <br />
