~-a~ Councilrnember introduced the following resolution and moved for its adoption: RESOLUTION #09-OS-XXX RESOLUTION DIRECTING THE PREPARATION OF PLANS AND SPECIFICATIONS FOR IP 08-33 THE BITUMINOUS PAVING OF UTE STREET NORTH OF 179TH LANE WHEREAS, pursuant to a motion of the Ramsey City Council, adopted May 27; 2008, a feasibility study for Improvement Project #08-33 The Bituminous Paving of Ute Street North of 179`h Lane has been prepared by Steve Jankowski, City Engineer; and, WHEREAS, the report was received by the Ramsey City Council on March 10, 2009 which WHEREAS, teri days' mailed notice and two weeks' published notice of the hearing was given, and the hearing was held. on .the 14`h day of April, 2009 at Ramsey City Hall 7550 Sunwood Drive NW at 7:00 p.m. at which time all persons desiring to be heard were given an opportunity to be heard thereon; and WHEREAS, the time available for the receipt of a petition opposing the project has expired; and WHEREAS, Section 8.4.1 of the City Charter states that the project may not be ordered for 60 days from the close of the public hearing. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the improvement is necessary, cost-effective, and feasible as detailed in the feasibility study report. 2) That the City Engineer is hereby designated as the engineer for this improvement. 3) That the engineer shall prepare-plans and specifications for the making of such improvement. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember and upon vote being taken thereon, the following voted in favor thereof: and-the following voted against the same: and the following abstained: and the following were absent: where upon said resolution was declared duly passed and adopted by the Ramsey City Council this the 12th day of May 2009.
